All rights reserved. http://www.usgwarchives.net/copyright.htm This file was contributed for use in the USGenWeb Archives by: Carole Gibson ********************************************************************************************************** Rutherford County Deeds Book W (partial) TSLA Microfilm Roll #113 Rook W, page 63-64, No. 73 Deed No. 73 Benjamin Beaty to Hezekiah Howse; deed 117 acres This Indenture made the 22nd day of January, one thousand eight hundred and thirty six, between Benjamin Batey of the County of Rutherford and State of Tennessee of the one part, and Hezekiah Howse of the County and State aforesaid of the other part; Witnesseth, that for and in consideration of the sum of one thousand six hundred and fifty two dollars and thirty seven cents, to the said Benjamin Batey to him in hand paid by the said Hezekiah Howse I the aforesaid Benjamin Batey have bargained, granted and sold, and by these presents, do bargain, grant and sell and convey, unto the said Hezekiah Howse his heirs and assignees one certain part of land lying in the County and State aforesaid, and on the waters of Overalls Creek. Beginning on a Stone and Hickory the south East corner of said Survey, thence west with Solomon Beesleyšs line two hundred and fifteen poles to Everett Haynešs corner, thence north Eleven west with said Haynešs line fifty four poles to a stake, thence East one hundred and eleven poles to a Dogwood, thence South fifteen and one fourth poles to a stake, thence South to the beginning. Containing by survey one hundred and seventeen acres, to have and to hold the aforesaid bargained premises with all and singular the privileges thereunto belonging or in any wise appertaining unto him the aforesaid Hezekiah Howse his heirs & assignees, and I the aforesaid Benjamin Batey for myself my heirs Executors & administrators do warrant and defend the aforesaid bargained premises against the lawful claims of all persons whatsoever, unto him the aforesaid Hezekiah Howse his heirs & assignees.
