Blair to Lemuel M. Baird; Deed of Trust [note: the wives of these two men were sisters] This Indenture made and entered into this 16th day of October A.D. 1837, between Alexander M. Blair of Rutherford County, in the State of Tennessee, of the one part, and Lemuel M. Baird of the same County and State of the other part, witnesseth‹that whereas the said Alexander Blair is indebted to Charles Ready of the County & State aforesaid by note, in the sum of two hundred and fifty dollars, and to Andrew J. Hoover of the Same County and State in the sum of two hundred and fifty dollars, which said sums are to fall due on the 25th day of December 1838. And whereas the said Alexander is indebted to [ ] other persons, whose names and whose debts are not here specially mentioned and set out because the amount of the different debts is not accurately known; and whereas also the said Alexander is desirous of securing some means of support to his wife Malinda W. and to his children, namely Alexander Henderson, William Thomas and James Lawson White. Now therefore, for and in consideration of the premises, and for the further consideration of one dollar to him the said Alexander in hand paid by the said Lemuel M. Baird, the receipt whereof is hereby acknowledged, the said Alexander hath bargained, sold, aliened and conveyed, and by these presents doth bargain, sell, alien and convey, to the said Lemuel M. Barid, a certain tract or parcel of land, situate and lying in Rutherford County aforesaid, on the waters of the west fork of Stones River and bounded as follows, to wit, on the South by the lands of Alston Prater & Eli Epps which were sold to them by William Mayfield, on the East by lands claimed by B.E. Mayfield, on the north by the Hurricane, and on the West by the lands of Bailey Pinkard. Beginning at a Chinquapin oak on said Pinkardıs East boundary line 144 poles north of Goodlettıs north west corner running thence East with Eppıs & Praterıs line 104 poles to a stake, thence north ninety poles to a stake, thence west to the path on the top of the ridge which runs from Eppıs to Mayfieldıs, thence south ­ degrees west poles to an Elm on Pinkardıs East boundary line, thence South 40 poles to the beginning. Containing by estimation Forty acres, be the same more or less, with the hereditaments and appurtenances thereunto belonging. Also one negro girl slave for life named Violet fourteen years of age, one negro girl slave for life named Mary Jane six or seven years old, one Black Stud Horse called David Crockett, five years old last Spring, one brown gelding three years old last Spring, one sorrel gelding, four years old last Spring, one bay mare eight or nine years old, and her sucking foal, one bay filly by Havoo [?], three years old last Spring, one bay filly by Rackingham, one year old last spring, three cows and calves, one heifer yearling, four bedsteads and furniture, one china press and the furniture therein, one Bureau, one Sofa, one work stand, one candle stand, one dining, two breakfast & two dressing tables, one patent clock, one dozen chairs, one looking glass, one [?], one tea kettle, three trunks, one carry all waggon & harness, one dismount, one ca[?], one shovel and one bull tongue plough, two pain gear [?], one manıs one ladies and one boys saddle, two judgements against Anderson Searcy Jr. for sixty eight dollars each rendered by Samuel L. Parrish Esq. on the 28th of September 1836, one note on Royal & Thomas Sparks, for one hundred and twenty five dollars, due on the 1st day of January 1837, one judgement against William Goodwin rendered in 1834 for sixty dollars, one note on R.D. Blair for thirty five dollars, due the 25th day of December 1837, one note on Alexander [Daroning?] for fifteen dollars due 25 December 1837, one note on B.E. Mayfield on which a balance is due of eleven dollars, and a receipt on B.E. Mayfield for twenty dollars for which he is bound to pay timber. To have and to hold said land and bargained premises with the appurtenances and hereditaments and appurtenances thereunto belonging, also said slave houses, and cows with their increase, also said household & kitchen furniture & farming utensils, judgements, notes & receipts, to the said Lemuel M. Baird his heirs, executors & administrators, to and for the following uses & trusts, and for no other purpose whatsoever. That is to say in trust to pay first the aforesaid debts due to Charles Ready and Andrew J. Hoover, together with all the other debts which the said Alexander Blair may now owe, as well those not mentioned herein before as those which are mentioned and specified, to be paid as they shall respectively fall due, for which purpose the said Baird is hereby invested with full power and authority to sell any or all of said property real and personal either at public or private sale as he may deem most expedient, and after paying off all the debts now owing by said Alexander Blair, and all charges and expenses incident to carrying this trust into effect, if there shall remain any balance of the proceeds of the aforesaid property real and personal, the said Baird shall hold the same in trust for the use and benefit of Malinda W. the wife of the said Alexander Blair and his aforesaid children to be by him applied to their use and benefit in supporting, clothing and educating them, as their circumstances in his judgement, may require. The said Alexander Blair is to remain however in possession of the aforesaid property real and personal, except the said judgement, notes & receipts until it shall become necessary for the said Baird to take the same into his possession to dispose of for the payment of the said Alexanderıs debts. The said notes & receipt are at the date hereof assigned over and delivered to said Baird, and his is to take the immediate control of the said judgements, for the purposes aforesaid.
