H. Burt To: Mortgage A. B. Payne I this day assign to A. B. PAYNE all my right title and interest one thirds in a town lot in Lavergne Rutherford County Tennessee and known as the lot of W. H. BURT Decąd. and I covenant and bind myself my heirs &c. to defend the right and title to the same but it is hereby agreed and provided that if I pay or cause to be paid to the said A. B. PAYNE within twelve months from this date the sum of two hundred dollars which has this day loaned the above obligation to be void and of no effect, otherwise in full force and virtue. Burt And wife 8th Oct 1872 To: Deed Trust Wm. N. MASON This indenture made the 4th day of October 1872 between W. H. BURT and wife F.E. BURT of the first part Wm. N. Mason of the Second part. Witnesseth, that the said parties of the first part in consideration of the Sum of Five dollars lawful money of the United States, to them paid, has sold, and by these presents due grant, and convey to the said party of the Second part, all the right title, interest, and claim that we have in and to the crops now on the lands of Wm. N. Mason. A.B. Payne, also on the land belonging to the Estate of J. B. Buchannan Decąd, also on the land & belonging to W. H. Barrishairs, containing by estimation Forty five acres in cotton and thirty acres in corn, and one and one half in goober peas, with all the title and interest of the parties of the first part in said crop, it being two thirds (2/3) of said crops, after the hands are paid for cultivating said crops. This deed is intended as a security for the payment of the following debts, (viz) That is to say, We are indebted to A. Davis in the Sum of Forty six & 70/100 dollars ($46.70) We are indebted to McAlister & Wheeless in the Sum of One hundred and thirty dollars ($130.00). We are indebted to S. B. Spurlock & Co. in the Sum of about Three hundred dollars ($300.00) We are also indebted to Wm. N. Mason in the Sum of about one hundred dollars ($100.00) We are also indebted to Alfred Ross in the sum of Seventy Eight dollars ($78.00) We are also indebted to William Cutchen in the Sum of Seventy five dollars ($75.00) And being desirous to secure and make certain the payment of said debts, we do authorize the said Wm. N. Mason to proceed at once to take possession of Said crops, and gather them, and to sell the same and apply the proceeds first to all necessary cost and expenses, Secondly, to the payment of the above debts if sufficient, if not, a pro rata is to be made, and if any money should remain in the hands of our trustee after the payment of the above debts, to be paid to us, or on our order. OSLIN Clerk of the County Court of said County , W.H. Burt and F.E. Burt, the bargainors with whom I am personally acquainted, and acknowledged that they executed the foregoing instrument for the purposes therein contained and F.E. BURT (the feme covert?) having also personally appeared before me privately and apart from her husband the said W.H. Burt, acknowledged the execution of Said instrument to have been done by her freely, voluntarily, and understandingly, without compulsions or constraint from her said husband, and for the purposes therein expressed. Booker To: Lien W.C. Burt I, G. J. Booker have this day executed eight notes, each one calling for fifty dollars with interest at six percent from the 1st day of April 1874 to Wm. C. Burt for the furniture, fixtures and appurtenances of the Post Office in the town of Murfreesboro Tenn. The 1st note is due June 30th 1874 2nd due Sept 30th 1874 3rd due Decr 31st 1874 4th due March 31st 1875 5th due June 30th 1875 6th due Sept. 30th 1875 7th due 31st Dec 1875 8th and last note due 31st March 1876 My right and ownership to the above described property is to date from the 1st of April 1874. But the said Wm. C. Burt retains a lien on the whole until all the notes are paid. This March 18th 1874. G.J. Booker State of Tennessee Rutherford County Personally appeared before me James O. Oslin, Clerk of the County Court of said County G.J. Booker the bargainer with whom I am personally acquainted and acknowledges that he executed the foregoing instrument for the purposes therein contained. BURT} State of Tennessee Rutherford County For and in consideration of the sum of one dollar to me in hand paid, the receipt of which is hereby acknowledged, I have this day sold and bargained and do hereby convey to W.H. BURT, one Sorghum pan and furnace to same to have and to hold, the terms of this agreement are as follows, I am indebted to the said Burt in the sum of Forty three dollars evidenced by my promissory note dated Sept. 21st 1893. And due Sept. 21st 1894, with interest from date. Now if Pay or caused to be paid to the said Burt, the above mentioned sum then this obligation to be null and void, otherwise in full force and effect. Sept. 15 1896. Witness J.H.
