All rights reserved. http://www.usgwarchives.net/copyright.htm This file was contributed for use in the USGenWeb Archives by: Deborah Thurman Parks *************************************************************************************** Rutherford County Deed Book 2 page 318 This indenture made this 17th day of October 1845 by and between Elizabeth Davis of the County of Rutherford State of Tennessee of the first part, and Berry Thurman & his wife Willy Anne of the County of Cumberland & State of Kentucky, John Lasater & his wife Nancy, Ellis Davis, Henry Jones & his wife Martha L. the last of the County of Rutherford except Lasater & wife who resides in the County of Wilson, State of Tennessee of the second part witnesseth that the said Elizabeth for the consideration of natural love & affection she bears to the said parties of the second part, her children and sons in law & for the further consideration of one dollar to her in hand paid at the ensealing & delivery of these presents, hath given granted bargained & sold surrendered up and conveyed & doth by these presents give grant bargain & sell surrender up and convey to the said parties of the second part their heirs executors and administrators and assigns all the right title claim & interest she has in & to the two tract of land lying in the County of Rutherford on the north side of Bradleys Creek one purchased by Lewis Davis dec. of John Donelson, containing about two hundred acres & the other purchased of Daniel Hoskins & adjoining the first on the east containing about one hundred and three acres devised to her by the will of her deceased husband Lewis Davis for & during her life or widowhood excepting one hundred & thee acres the northern part of the first mentioned tract including all the buildings orchard on said tract bounded as follows; Beginning on a white oak the north east corner of the 200 acre tract, thence west with the north boundary line three degrees east 162/4 poles to the northwest corner, thence south with the west boundary one hundred and sixteen poles to a stake in the mouth of McAdeos Lane thence east to the east boundary of said tract one hundred and forty two poles a white oak marked E.D. thence north with the east boundary to the beginning containing about one hundred and three acres which the reserves out of said tracts of land for and during her natural life to have & to hold said bargained premises with the appurtenances unto the said parties of the second part (the said husbands & their wives to have each the one undivided sixth part of said lands and each of the unmarried children the undivided one sixth part of the same) their heirs and assignees forever. And for the consideration aforesaid to the said parties of the second part, the following slaves for life bequeathed to he by the will of her said husband during her life or widowhood namely Loney about 35 years old, Andy about 25, Jim about 20, Dina 55, Ginny 35, Adeline 10, Anny 23, Green 9, Edmund 7 Nice 2, to have & to hold said slaves for life unto the said parties of the second part their heirs & assignees forever (each of said unmarried children to have an undivided one sixth interest in said slaves & said husbands & wives to have also an undivided one sixth part of the same, said land & slaves aforesaid being given up and surrendered to said children to enable them to divide the same or the properties if sold equally amongst the said Elizabeth's children. The said children being entitled after my death by the will of their father to an equal interest absolutely in said land & slaves. It is understood however that said Elizabeth is to have the use of said land & slaves until the present crop gathered & secured, and the said Elizabeth hereby reserves the balance of said slaves, given to her as aforesaid by the will of her deceased husband for & during her natural life.
