This file was contributed for use in the USGenWeb Archives by: Carole Gibson ==================================================================================== Book U, page 381; deed of trust, William Gibson to John Bellah 1835/1835 This Indenture made and entered into this Eighteenth day of February 1835, between William Gibson of the County of Rutherford and State of Tennessee of the one part, and John Bellah of the County and State aforesaid of the other part, witnesseth, that the said William for and in consideration of the love and affection which he hath for his wife Nancy and his Sons Moses, James, John, William, Samuel, Anderson, Matthew, Alfred and his daughters Elizabeth and Mary Gibson; and for and in consideration of the Sum of one dollar to him in hand paid by the said John Bellah, the receipt whereof is hereby acknowledged, hath this day granted, bargained & sold, and by these presents doth grant, bargain, sell, alien [ ], convey and deliver unto the said John Bellah the following described property viz. six negroes, Ritta aged about thirty, Hacey (?) aged about twelve or thirteen, Peter aged about ten or eleven, Louisy aged about eight or nine, & Ned aged about seven or eight and Henry aged about twenty-four. Also three head of horses, eight head of cows, all of my st[] of hogs, five beds, bedsteads & furniture, one clock, one burea[u] and one chest. To have and to hold to the said John Bellah his heirs and assignees forever In trust nonetheless, and to and for the separate use and benefits of my said wife Nancy Gibson for and during the term of her natural life, and it is the design and intention of these presents that the said John Bellah is to apply the hire of the negroes and use of the other property herein before described to the sale and separate use and benefit of my said wife Nancy and the above named children and any other children I may have by my said wife Nancy in their support and maintenance and the same is not to be subject to my debts or contracts hereinafter to be made but all the debts that I now owe are first to be paid and satisfied and if the proceeds of my land which I have contracted to sell be not sufficient to pay all my debts, then and in that case the said John Bellah is authorized and empowered to sell so much of the above described property as may be sufficient for that purpose. And it is further understood the said John Bellah may either hire out the above negroes and apply the hire to the support and maintence of my wife and children as above or if he thinks best he may place the said negroes upon some [farm] with my said wife Nancy and children to work and labor for their support as aforesaid, and after the death of my said wife in trust that the said John Bellah, his heirs and assignees shall distribute said negroes and the incresease as well as the other property herein before described and the increase therefrom and such of the profits as may not be required in the support and maintenence of my said wife Nancy and children equally to and amongst all of the above named children and such children I may hereafter have by my said wife Nancy, share and share alike and if it should so happen that any of my children should die having issue lawfully begotten before the death of my said wife in that event the children of such so dying to share the portion of which would fall to his [ ] or their parents were they then living.
