Witnesseth that the said JOHN HILL for and in consideration of the sum of four thousand six hundred dollars to him in hand paid by the same MATHEW NELSON the receipt whereof is hereby acknowledged hath given, granted, bargained and sold & by these presents doth give, grant, bargain and sell alien, release convey and confirm unto the said MATHEW NELSON his heirs and assigns a certain tract piece or parcel of land situated, lying and being in the County of Rutherford and State aforesaid on the Hurricane Creek of Stones River which is butted and bounded as follows; to wit, Beginning in the center between a Sassafras and black oak, the east boundary of a certain six hundred and forty acre tract granted by the State of North Carolina to GREEN HILL being two hundred and six poles North of a Line the beginning corner of GREEN HILLs survey and the East corner of a tract Granted by the State of North Carolina to NANCY & ELIZABETH REARDON which oak & sassafras is near the South of the said bargained premises and running west with the marked line to a rock and mulberry in the west boundary line of said GREEN HILLs survey, Thence north with the line of said survey to a hickory the north west corner of said GREEN HILLs tract, Thence East with the line of the said GREEN HILLs survey to a rock near an Ironwood, Thence South with said survey to the beginning. Also a certain tract lying and being in the County of Rutherford and State aforesaid and bounded as follows; to wit, Beginning at an elm near the South east corner of the above described tract and running thence East twenty poles to a stake; thence north eighty poles to a stake, and thence west twenty poles to a stake in the line of the above described tract; Thence South with said line eighty poles to the beginning. The whole including the two described tracts or parcels of land containing three hundred and fifty acres more or less being the tract whereon the said M. NELSON now lives. To have and to hold the said tract, piece or parcel of land with all and singular the improvements, hereditaments and appurtenances unto belonging or in any way appertaining to him the said MATHEW NELSON his heirs and assigns to his and their only proper use benefit and behalf forever; And the said JOHN HILL for himself, his heirs, executor and administrators, doth covenant, promise and agree to & with the said MATHEW NELSON his heirs & assigns, that the title to the above described tract piece or parcel of land he and they will warrant and forever defend against the title claim and demand of all and every person or persons whatsoever with the following exception and reservation; To wit, one acre and ninety-two poles including the METHODIST CHURCH and which was deeded by the said JOHN HILL for the use and benefit of the METHODIST EPISCOPAL CHURCH in the United States, setting up title to the same in law or equity and further that the said JOHN HILL hath a good title to the lands - - -- - aforesaid and is well enabled to convey the same against the title claim or ------ of all and every person or persons whatsoever. NELSON a subscribing witness to the within deed who being first - - - depose and say that he’s acquainted with the within named JOHN HILL the bargainer and that he acknowledges the same in his presence to be his act and deed upon the day it bears date. Witness my hand at office this 10th day of February 1840.
