Deceased Source: Rutherford County, TN Record Book 19, pp. 68-70. Know all men by these presents that I, Hiram Jenkins, Sr., of the County of Rutherford and State of Tennessee, being in a low state of health but of sound and disposing mind, do by these make and constitute this my last Will and Testament, revoking all others this 24th day of January 1852. Item 1st. I give and bequeath to my wife during her natural life five Negroes named as follows & to _________a woman named Monning(?) and a woman named Edy and her three children named Frederick, Edmond and Mary and at the death of my wife my will is that she shall give the said five Negroes to one or more of my children or their heirs as she may think best, with the increase of said Negroes. Item 2. I give and bequeath to my wife the southwest corner of the tract of land on which I now live beginning at W. H. Smith northeast corner of what is known as the Wheeler place, thence north with my son Nimrod’s line to the Murfreesboro Road to said Nimrod northwest corner, thence west with the center of the road to my Brother Nimrod’s line, thence south with his line to W. H. Smith’s corner in the Wheeler Tract. Thence west with said line to the beginning said described land, I give to my wife during her natural life and at her death my wife during her natural life and at her death my will is that she shall give said described land to one or more of my children or their heirs as she shall think proper. Item 3rd. I give to my wife all of my household and kitchen furniture with all the provisions of every kind on the place to dispose of as she may think proper. Item 4th. I give to my wife all my horses, hogs, cattle, and sheep to do with as she may think proper. Item 5th. I give and bequeath to my son, Nimrod Jenkins, what is known as the little cotton field north of the Murfreesboro Road and also I give said Nimrod fifty acres of woodland north of said little field making about fifty eight acres in all. Item 6th. I give and bequeath to my son, Hiram Jenkins, one hundred acres on the north side of the road adjoining Nimrod on the east side to him and his heirs forever The land given to Nimrod to him and his heirs forever. Item 7th. I give and bequeath to the heirs of my Brothers’ and Sisters’ children who are dead & I mean those heirs who will not get any part of my Brother, Nimrod’s estate in consequence of the death of my Brothers’ and Sisters’ children since the making of said Nimrod’s will, one hundred & twenty eight acres of land adjoining the lands of Burne’s (?) & Overalls, beginning at the southwest corner of said Overall’s, thince south with W. H. Smith line to Two Sycamore’s, thince east to a corner made by Commissioners, thince north with an old line to a port oak, thence west with Burne’s and Overall’s line to the beginning. I will that my executors sell said land upon the usual credit and fraz (?) over the proceeds of side land in equal shares to the said heirs of my Brothers’ and Sisters children. Item 8th. I give and bequeath to my son, Hiram Jenkins, during his natural life all the balance of my lands on the north side of the road and at the death of said Hiram my will is that it be equally divided between his present children. Item 9th. I wish it distinctly understood, that two thirds of all the stock on the farm belongs to my son, Nimrod, and that there has been a full settlement between Nimrod and myself in relation to all the crops made on the farm up to this day and I do hereby appoint my sons Hiram and Nimrod as Executors to this my last Will and Testament witness my hand and seal the day and date above written. I, Hiram Jenkins, by these presence, make this codicil to my last Will & Testament November 3rd, 1853 and my object in making this codicil is to say that I have given heretofore to my four oldest children a full share to each in money and lands, which I gave to them in the State of Missouri, which I consider their full fraction of my estate.
