Daniel Kerr was born March 18, 1794 in either NC or Va. and died February 22, 1875 in Sevier County, Tennessee. He married (1) Alsey Goforth circa 1820 in Sevier Co. He married (2) Sarah "Sallie" Petty 1841 in Sevier County. His brother, John Kerr Jr., was the Justice of the Peace for Sevier County and performed the marriage of Daniel and Sarah in Daniel's home. Sarah Petty was the daughter of James Petty and Peggy Robertson. I have transcribed this gift of deed exactly as written except for the names and/or explanations in parenthesis, which I have added for the benefit of the reader. This is not only valuable for the names of the heirs of Daniel and Sarah, but for the mentions of their neighbors whose lands bordered their own. Gift of Deed State of Tennessee Sevier County We Daniel Kerr and Sarah Kerr my wife for the love that we have for our children and being desirous to do equity between them whilst we are right with them and we in our minds have proceeded to a lot and set a part to our said heirs our real estate by cutting it up in to Lots as we wish it to remain and stand in the future with the following reservation. For our own support and protections while we as either of us are spared to remain upon the earth reservations first whilst either of us are spared to live we reserve our old mansion house and the houses about the same for our own either of our own use also we reserve one acre of land about the same or any where else on the farm we might desire for our little truck patches we do further reserve for our own use the priviledge of using any froots as long as there is any as same as we have done heretofore and we do further reserve and hold our life times support off one of the lands set a part to our children or heirs as to have full possessions of their divided interests of the lands with the above reservations and they in proportion to the lands set a part to them as to yearly have and put up for us or either of us which should survive the other sufficient for us a good and compfortable support out of the products of the said lands now with the foregoing reservations we do for the love we entertain for our heirs give to them the following described tracts of land as laid down on a map with their numbers in the map and the field notes to represent the same. The Lot No. 1 is the Lands we give and assign to our Daughter Harriett Roberts and her heirs or assigns it being in 2 separate pieces. The Lot No. 2 all joins is the lands we give and assign to our son Henry C. Kerr and his heirs or assigns the Lots No 3 in 2 separate pieces is the lands we give and assign to our son David W. Kerr and his heirs or assigns the Lot No 4 all joins the the lands we give and assign to our daughter Nancy A. Kerr and her heirs or assigns the Lot No 5 all joins the lands we give and assign to our daughter Manerva Kerr and her heirs or assigns Lots No 6 is in 2 different pieces is the lands we give and assign to our daughter Sarah Roberts and her heirs or assigns Lot No 7 is the land we give to our heir Mariah Tolbert and her heirs or assigns Lot No 8 is the land we give to our Grandchildren, two girls (Hannah and Clarissa), and their heirs or assigns then there is a lot reserved that we still hold. No 1 Boundry lines of the division of the Daniel Kerr lands of each heirs lots Harriett Roberts No 1 being in 2 pieces the timbered lot 17 acres. Begins at a stake between a pine & post oak corner to L.C. Roberts (Levi C. Roberts husband of Harriett Kerr Roberts) lands and runs with the same N 21 1/2 E. 39 poles to a white oak corner to Lot No 2 timbered Land with said Lot S 25 E 62 1/2 poles to stake & pointers on a ridge with said ridge S 31 W. 32 poles to a hickory on Trotters line with his line S 73 W 45 poles stake & pointers corner to same & L.C. Roberts then with Roberts line N 11 E 22 poles to black oak with same N 31 E 28 poles to a post oak with same North 17 poles to the Beginning the second piece being the cleared lot of said division lying on the North Side of Flat Creek adjoining J.T. Trotter Beginning at a white oak corner to said Trotter and containing 23 3/4 acres running with Trotter N 33 E 108 poles to a stake & pointers on Benj. Atchley line with it East 10 poles to a stake & pointers corner to same with same S 58 E 9 1/2 poles to a stake with same S 81 E 16 1/2 poles to a stake & pointers corner to Lot No 3 cleared land with said lot S 33 W 110 poles to a stake in Flat Creek then down said creek & with Mc Trotters (Mc is probably the first name Mac) line to the beginning. Lot No 2 H.C. Kerrs (Henry C. Kerr) all joins or just cut a part by a Maple Tree said lot begins at a black walnut a corner to Mc Trotter and a corner to Lot No 3 and runs with said Trotter up Flatt Creek S 43 E 31 poles to a Elm corner to the same with the same S 18 W 43 poles to a black gum with same S 39 W 16 poles to a white oak on said line & corner to L.C. Roberts with his line S 36 E 51 poles to a white oak with same S 39 W 21 1/3 poles to a post oak & ironwood S 15 E 15 4/5 poles to a ash with same S 21 1/2 W 20 poles to a white oak corner to Lot No 1 timbered land with it S 25 E 62 1/2 poles to a stake & pointers on a ridge corner to same then with said ridge N 29 1/4 E 33 poles to a stake & 3 post oaks N 17 E 35 poles to a pine & post oak on a high ridge corner to Lot No 4 with it N 39 1/2 W 56 poles to a white oak with same N 58 1/2 E 16 feet from the Spring then through the center of the Spring N 3 W 28 poles & 18 links to a stake about 4 feet from a marked Persimmon N 41 1/2 W 22 poles & 14 links to a stake N 11 1/2 E 41 poles to a sweet gum on the South Bank of Flat Creek at the foot log & then crossing said Creek N 35 W 17 poles to a Stake N 32 1/2 E 82 1/2 poles to a stake on the line of Lot No 7 then with said line N 41 1/2 W 22 poles to a stake on line of lot No 3 with it S 33 W 90 1/2 poles to the beginning containing in all 46 1/4 acres. The 3 Lot David W. Kerr lyies in 2 different Tracts 1 Lot a timbered piece containing 28 1/4 acres bounded as follows Beginning at a ash corner to Robt. Sneed & running with the same N 80 W 65 poles to a spanish oak N 9 1/2 E 52 poles to a spanish oak & hickory in part with Lot No 5 then with Lot No 8 N 52 E 18 poles to a pine S 85 E 28 poles to a small pine S 38 E 19 poles to a post oak S 14 E 15 poles to a stake & pointers S 55 E 18 poles small spanish oak S 47 E 18 poles to small hickory on the line of the L. H. Catlett lands then with said line S 58 W 36 poles to the beginning the 2 piece cleared lands lying on the North side of Flat Creek adjoining Lot No 1 & No 2 beginning at a black walnut corner to Lot No 2 & Mc Trotters running with said Lot No 2 & No 7 N33 E 130 poles to a stake near a white oak corner to Benj. Lot No 6 2 lots A piece containing 38 3/4 acres it being Sarah Roberts Lot (Sarah Kerr md. William M. Roberts, brother of Levi C. Roberts) begins at a stake in the Creek below the Mill Dam and runs with James Lindsey line S 45 W 38 poles to a Hickory on a ridge corner to Lot No 8 then with said Lot N 75 W 18 poles to a hickory with same S 55 1/2 W 30 poles to a stake corner to Lot No 5 then with said Lot N 25 1/2 W 107 1/2 poles to stake in the Creek then with said Creek & Lot and the Creek & Lot of No 4 to Benjamin Atchley corner then with said Atchley & Creek up to the Beginning as the Creek winds. Second Lot containing ten acres begins at a stake on a ridge corner to Lots No 1 & 2 then with No 2 N 29 1/2 E 33 poles to a stake & pointers with same N 17 E 19 poles to a post oak S 49 E with reserve Lot 43 1/2 to a stake & pointer on Trotters Line with it S 45 W 51 poles to a lot sold to Margarett Henry then with her line N 43 W 24 1/4 poles to the Beginning. Lot No 7 Mariah Tolbert Containing 14 1/2 acres beginning at a stake corner to Benj. Atchley on the North Side of Flat Creek & runs with the same N 34 E 65 poles to stake & pointers with the same S 75 W 14 1/2 poles to a stake & post oak with same N 27 1/2 W 18 poles to a white oak with same S 80 W 28 poles to a big oak & post oak N 16 1/2 E 9 poles to a white oak S 84 W 1 to a stake corner to Lot No 3 the with said Lot S 33 W 39 1/2 poles to a stake corner to Lot No 2 then with said Lot & Lot No 4 S 41 1/2 E 50 1/2 poles to the Beginning. Lot No 8 W.P. Kerrs heirs two girls (Clarissa and Hannah) containing 28 acres and bounded as follows Beginning at a white oak corner to the L.H. Catlett Lands & runs with the same S 58 W 22 poles to a small hickory corner to Lot No 3 timbered lot then with said Lot N 47 W 18 poles to a small spanish oak N 55 W 18 poles to a stake & pointers N 14 W 15 poles to a post oak N 38 W 19 poles to a small pine N 85 W 28 poles to a large pine S 52 W 18 poles to a spanish oak & hickory corner to same & Lot No 5 then with said No 5 N 22 W 20 poles to a white oak N 12 E 16 poles to a stake & pointers N 47 1/2 E 10 poles to stake & pointers corner to same & Lot No 6 with said Lot n 55 1/2 E 30 poles to a hickory with same S 75 E 18 poles to a hickory corner to same & on James Lindsey line then with said Lindseys line S 45 W 7 poles to stake his corner then with the same about S 35 E about 103 poles to the Beginning. Also, there is a small piece of 2 1/2 acres contracted to Margarett H. Henry if she ever pays for it then she is to have title to it and if she does not pay for it she is to give possession when demanded. So to do and we do further warrant and defer the titles to the said lands as the division now stands to each and every one of our heirs and all others claiming through or by us and every other person whatever this being all one the Last Deed made to our real estate and we do this being in our right minds and thinking it our duties to do so in testamony hereof we do hereunto set our hands & seals on this the 10th day of May 1872.
