Roberts.. Knoxville, Tennessee 18 October 1934 Know all men by these present that I, A. W. Roberts, a resident of Sevierville, Tennessee, being of sound mind and memory, and desiring to dispose of my property before I depart this life, do hereby make, publish and declare this as my Last Will and Testament, hereby revoking and making void all former wills made by me at any time heretofore. 1. I direct that my executor herein after named, collect all my debts, either by notes, accounts or insurance, that may be due me at that time and to pay all my just debts and funeral expenses as soon as possible. 2. I give, devise, and bequeath to my wife, Nannie Belle Robets, the following property to wit: The house and lot where I now reside in the town of Sevierville, Tennessee, located at 204 East Main Street, known as the Old Catlett Home, to rent, or live in, as she may desire, until her death or remarriage and in case of either, then the title shall pass to James H. Hines, Jr., a resident of Knoxville, Tennessee. I also will and bequeath to her a lot in the Love Addition to the town of Sevierville, Tennessee, known as lot no. 29 and adjoining the Catlettsburg Pike and Jonas Stofle, and others, this lot to be disposed of as she may see fit, and the proceeds used as she cares to. I also will and bequeath to her the proceeds or interest derived there- from from the following to wit: The interest from the Volunteer Building and Loan Association, a Corporation doing business in the city of Knoxville, Tennessee, now containing $4000.00, said interest being paid twice a year. Also I give to her the interest derived from my stock of $1500.00 which I own with the Southern Industrial Banking Corporation, a corporation doing business in the city of Knoxville, Tennessee, the interest being paid twice a year. I also will and bequeath to her my stock which I own in the Bank of Sevierville, Tennessee. Also, all of the household and kitchen utensils, other than what is mentioned following this will. But at her death or remarriage the titles in said Building and Loan as well as the Southern Banking Corporation shall pass to James H. Hines, Jr., where said amounts are to remain unless they cease to function, then said money shall be placed in Government Bonds or some other solvent concern and the interest only used. I also will and bequeath to her my stock in the East Tennessee Building and Loan Association, consisting of about $1000.00 being about a toal of $10,000.00 which I think is just and right, considering all things. 3. I will and devise to Hallie D. Roberts and Mrs. W.L. Dudley, my sisters, jointly the house and farm that I own at Powder Springs, known as the N.C. Atchley place, to have and to hold during their life time and at their death then said title shall pass to the heirs of Jama Hodges Leatherwood, my niece. 4. I will and bequeath to my sisters, Hallie D. Roberts and Martha A. Hodges, jointly the other place I own at Powder Springs known as the Ward place and later as the G.W. Hardy place, this property to be owned by them jointly until their deaths, then the title shall pass to the heir or heirs of Jama Hodges Leatherwood, my niece. 5. I will and bequeath to the Trustees of the First Methodist Episcopal Church in Sevierville, Tennessee and their successors as such Trustees, the interest derived from my stock of $500.00 in the Sevierville Hosiery Mills, this sum to be applied each three months on the pastor's salary, the amount being each three month, at this time $8.75 and this shall be the authority for the Chairman of the Board of Trustees to draw on this fund, and should this mill cease to function, the money derived therefrom shall be placed at interest and used on for the payment on the pastor's salary. 6. I will and bequeath to my sisters, any old family heirlooms that may never have been divided, also I charge them to pass them on and keep them in the family as long as possible. 7. I will and bequeath to the Sevierville Library the following to wit: One complete set of the History of Nations, consisting of twenty-five books, also one set of Kiplings works, consisting of ten books, and one set of the works of Mark Twain, consisting of ten books; provided Miss Sharp does not want any of the sets. 8. I will and bequeath to my co-worker, Miss Helen M. Sharp, the following to wit: My stock which I own with the Home Building and Loan Association, a corporation doing business in the city of Knoxville, Tennessee, and at this time being in the amount of $6000.00, with the request that she use only the interest until such time as she is not able to work, then to dispose of it as she may desire. I also will and bequeath to her the farm I recently purchased from George W. Clark, known as the old Tarwater farm, located in the Tenth District of Sevier County, Tennessee, to have an use as she may see fit, at the time of my death, if the debt due the Federal Land Bank of Louisville, Ky., is not paid, I request that she take the interest derived from the Home Building and Loan Association and make payments on it until it is all paid. I further direct my executor hereinafter named, allow Miss Sharp to select any of the instruments, books, or office fixtures that she may desire, before any sale is ordered. I desire at this point to say that all the years Miss Sharp has been with me she has helped me accumulate what property I now have, and I feel it just and right, after all these years with me, working day and night with and without me, and saved and collected until I do not feel it right to go out into eternity and not provide for her in her old days, when she has spent the best days with me, helping me make what I now own. I fell that the property I am willing her will amount to at least $10,000.00 other than any office supplies. 9. I will and bequeath to Wilma Sharp a complete set of Encyclopedias of either she may wish to select. 10. I will and bequeath to James Morton, colored, the sum of $250.00, and instruct him to let it remain in Trust, provided he is with me at my death. 11. I further direct that my body be prepared for burial by the K. Rawlings Undertaking Company and that Miss Helen M. Sharp be allowed to supervise and see that I am dressed as I have instructed her, from time to time, and that my body be placed in a Metalic Casket, then into a metal grave vault, and that I be buried at Alder Branch Cemetery witht he rest of my family. 12. I further direct that the sum of $500.00 be set aside to erect a monument to my grave, and I charge my executor to see that this request is carried out. 13. I further direct that should there be any money left after all the above mentioned is paid out, the executor paid for his services, that it be equally divided between my heirs, namely Mrs. Martha A. Hodges, Hallie D. Roberts, Mrs. Carrie J. Dudley and Helen M. Sharp. 14. I further order and direct that should any of the heirs or beneficiaries of this will become dissatisfied with their parts or attempt to start a suit in Court or attempt to have this will set aside, then they forfeit any rights that I have given them under the provision of this will and testament, and their part or parts shall be equally divided between the other heirs and beneficiaries of this will. 15. In case My wife shall predecease me or we should be killed in an accident, then her part will be equally divided between my heirs, to wit: Martha A. Hodges, Hallie D. Roberts, Carrie J. Dudley and Helen M. Sharp. 16. I hereby nominate Roy Cox, Cashier of the Bank of Sevierville, Tennessee as Executor of this my last will and testament and I direct that he give Bond as required by law, covering cases of this kind and should he fail to qualify, I then direct that Judge R. B. Robertson act as such. In witness whereof, I have hereunto subscribed my name on this 18th Day of October, 1934. A.W. Roberts The foregoing instrument was subscribed by the testator, Dr. A.W. Roberts, in the city of Knoxville, Tennessee on this 18th Day of October, 1934, in our presence and was at the time and place published and declared by him to us to be his last will and testament and thereupon we, at his request, and in his presence and in the presence of each other, did subscribe our names thereto as attesting witnesses, this attestation clause having first been read aloud to us in the presence of the said testator. Roberts own handwriting and it is attached to the will: I will and bequeath to my wife the stock I own in the Southern Industrial Banking Corp., a firm doing business in the city of Knoxville, Tenn. I also will her the stock I own in the Bank of Sevierville, Tenn. during her lifetime, and at her death said stock be transfered to the First Methodist Church and the interest only be used. I also will her the sum of $20,000.00 cash. I instruct her to have my office remodeled and to have the rent, and to rent only to couples with children.
