FERGUSON & LAURY (?) his wife, JAS CARTER & JANE, his wife, JOHN THOMASON & AGNES, his wife, BOOKE PATE & SABE PATE; a/ANTHONY PATE, dec'd Be it remembered that at August Term 1827 of the Supreme Court of error & appeall held for the third judicial circuit at the court house in Sparta & on the 31st day of August 1827 this cause came to be heard before the Honorable Robert Whyte, Jacob Peck & Henry Crabb(?) the presiding judges & was heard upon the bill of the complt thro answer, replications exhibits the testimony taken in the cause and arguments of counsel on both sides when it appeared to the court that ANTHONY PATE the ancestor of defts employed the sd MARBLE STONE in l795 to purchase URIAH STONES interest in the negroes in the bill mentioned - that the sd MARBLE made sd purchase in that year pursuant to his agreement with sd ANTHONY - that the suit in Va. was carried on for sd ANTHONY's benefit - that he paid MARBLE STONE for making sd purchase from URIAH STONE this sd ANTHONY's trustee & agent - & that in atro(?) paid sd MARBLE the consideration advanded the sd URIAH for his equity of redemption in the negroes and this court being of opinion that the assignment procured by MARBLE STONE from URIAH STONE in 1806 as alledged in his bill & the interest acquired by it enured to the benefit of ANTHONY PATES representatives the defts in this suit - whereupon the court doth order adjudge & decree that the bill of the (??) be issued with costs & that execution issue Recorded Augt 1827 NOTES: By JINKS PATE LEE (Sept 1999) DAR records list the children of Anthony Pate as: Thomas Pate Stephen Pate Elizabeth Pate m. Michael Hogg Rebecca Pate m Losson McCabb Edward Pate m. Lucy (He is actually Son of Willeroy - DAR records are incorrect) John Pate Willeroy & Leroy (same person) However, this document seems to indicate that his children were: My DAR application with these corrections was accepted: Rhoda Pate m. John Anderson Laury Pate m. James C. Ferguson Jane Pate m. James Carter Agnes Pate m. John Thomason Sabe Pate (d. 1827) Booker Pate Stephen Pate (d. 1846) Willeroy Pate (d. l844) John Pate (d. 1837) - not listed in suit, was living in VA and wife or daughter??
