Witnesseth that John Gardner of the State of Tennessee and county of Summer hath bought of Joseph McCarty of the State afores'd & county of Stewart a certain tract or parcel of land containing one hundred acres Situated on Bear Creek for the sum of Three Hundred Dollars to me the said Joseph McCarty in hand paid the receipt whereof I acknowledge I myself therewith. To wit: Beginning at a White Oak in the South boundary of a Tract of Land granted by the State of North Carolina to John Mann bounded by the following from the aforesaid White Oak running North one hundred & fourteen pole to a Black oak Then West one hundred & forty & a half pole to a black oak Then South one hundred & fourteen pole to the South Boundary of original Survey then East one hundred & forty & one half pole to the beginning containing One Hundred acres as above. With all and singular profits in or on the said premises Thereto contained or in anywise thereto Appertaining and for the true performance of the Rights claim or title of the above mentioned premises. I the said Joseph McCarty for myself, my may Heirs or Execu Admrs or assigns doth covenant and agree to & with John Gardner him his heirs or assigns to forever Warrant & defend the title ot the above named land of one hundred clear of the rights or claim of any person or persons whatever in Witness whereof I have set my hand and seal's my seal the day & date above written.
