Will of Jacob McCarty 25 Dec 1811 In the name of God, Amen. I, Jacob McCarty, of the County of Stewart and State of Tennessee, being very sick and weak, but in and of perfect mind and memory, do make and ordain this my last will and testament. First, I recommend my soul in the hands of Almighty God that gave it, and my body I give to the earth to be buried in a decent Christian burial at the discretion of my executors, as touching my worldly wherewith it has pleased God to bless me with, I dispose of in the following manner. First I will that my just debts be paid and that my wife, Catherine, have Dick and Lucy during her natural life together with my household furniture and farming tools, also horses and cattle sufficient for her use. Also, that my son, John, have $320.00 and the land he left on Guices Creek, and my daughter, Sarah have 50 acres of land, this tract whereon I now live to include the place where she now lives and to run down Guices Creek for complement. Also 100 acres of the lower end of the tract that William McAllister lives on and that James Taggert have 50 acres of the tract whereon I live which he bought from me to lie on the east side of Guices Creek and between the 50 I gave to his wife and the river. Also, my daughter, Hannah, have 200 acres of the lower side of the tract whereon she now lives to include the improvement where she lives to extend from one end of the tract to the other and that my daughter, Agnes, have two hundred and eighty acres of the upper end of the tract whereon she now lives on Guices Creek, and also my wife, Catherine, have my negro boy, Frank, for long as she lives and at her death to belong to my son, Jacob, and when my son, Jacob, is twenty-one years of age, all my land that remains shall be sold by my executors hereafter named. And my daughter, Mary, and son, Jacob, shall have $600.00 each to be raised out of my estate and the balance of my property to be equally divided among all my children that are now living. I do also constitute and appoint my wife, Catherine, and my sons, John, Joseph and Jacob McCarty and James Taggert executors of this my last will and testament.
