Keyes Jan 12, 2005 Source: LDS FHL film #972705 This Indenture made this twelvth day of November one thousand Seven hundred & ninety between Christian Weaver of the one part & John Funkhowser of the other part both of the County of Sullivan in the teritory of the United States of America South of the river Ohio Witnesseth that for & in Consideration of the Sum of two hundred [crossed out] & fifteen pounds Virginia Money to him the sd Christian Weaver well & truly paid in hand before the Sealing & delivering of these presents the Receipt whereof the sd Christian Weaver doth hereby acknowledge have bargained & sold in fee Simple & Confirmed unto the sd John Funkhowser his heirs Ext'r Adm's & Assigns forever one cer tain tract or parsel of land containing 280 Acres lying & being in the Coun ty of Sullivan on the South side of holston River including the plan tation whereon Michael Weaver formerly lived begining at three White oaks near the River South 42 East 141 poles to a hickory South 66 West 60 poles to a white oak South 50 West 240 poles, two; poles to a red oak North 40 West 140 along an old line to the River & then up the River the mean ders of the River to the begining together with all houses fences ways waters water courses orchards & all other appurtenances thereunto belonging with all rents and reversions of rents & all other the Estate right title that may now or ever after appertain to the same free from all hindrance of any person whatever Lawfully claiming the same to have & to hold and singular the aforesaid Lands & premises with every part & parsel there of from all incumbrances of Mortgages Dowers & reversion by or from me the said Christian Weaver or any other person whatsoever & to be to the only use of him the sd John Funkhowser his heirs Ext's Adm'r & Assigns for ever & lastly I the sd Christian Weaver do hereby promise Covenant & agree to & with the sd John Funkhowser his heirs Adm's & Assigns that I have full & the only right title & Lawfull authority to sell & Convey the aforesaid Lands & premicses & will at any time at the reasonable request & proper char ges of him the sd John Funkhowser make any other conveyance or assu rance that shall be Law required to pass the fee simple Estate of the a foresaid Land & premises from me the sd Christian Weaver to him the sd John Funkhowser his heirs Ext'r Adm's & Assigns for ever In Witness where of I have hereunto set my hand & Seal the day & year above written Signed Sealed & delivered in the presents of us his his Christian < Weaver (his mark seal) John Scott, Jacob ??
