HARRIET PERDUE -- Ex(amination) for complainants I am of lawful age I am a daughter of Joshua Wyatt, decd. He died the 6 day of Oct next 2 years ago. He said that he had received $50 from James King, the reputed father of Lee Perdue's wife and had put it into his brothers hands for the benefit of this child Lee Perdue's wife. When Benson married the mother of this child he and his wife went and drew the money from John King at the request of Joshua Wyatt. I have frequently heard the old man say that he would see that it should be paid to her that it was her right and that she should be paid. I heard him say this within a year before he died. It was about forty years ago that the old man said he had received the money in North Carolina and placed it in King's hands. ----Cross Ex(amination) by George W. Allen, Esq.----- Lee Perdue's wife is about forty six years old - was about 22 years old when she married. Heard the money spoken of before she married. Witness did not know whether Lee Perdue's wife knew of it before she left North Carolina. I know that my father wanted Benson to pay the money before she left North Carolina, and said that he would see that she should get it. She had no other property except that money that I know of. She was about 4 years old when Benson married her mother. Lee Perdue's wife after married lived within a short distance of my father. It was ten or twelve years after her marriage that I heard my father speak to Lee Perdue's wife about the money matter. In his conversations with her he said that she must contend for her money and that he would see that she was paid. My father was able to have paid that amt. at all times from the time it was put in his hands up to his death. Lee Perdue's wife was about 16 years old when my father left North Carolina. She left a few years afterwards. Both of the Kings have been dead a good many years. James King lived I suppose 12 or 15 years after the money was put into the hands of my father. He died on Goose Creek in this county he never lived here but came on a visit to see Lee Perdue's wife and my father. Harriet (herXmark) Perdue -------Re - Ex(amination) by complainants------ From the time Lee Perdue's wife went to Benson's until she married her service was worth more than her raising and clothing. She did all sorts of work and contributed to the support of the family working in the field and distillery, wove for all the family and received no education and cannot read or write. Have heard my father say that Benson got the money for the purpose of paying for some land and that it did go that way. Benson and his wife spoke of it in that way when they came to get the money. (Deft object to the re - examination of this witness, the examination having been closed). Harriet (herXmark) Perdue Additional Comments: This lawsuit filed in 1855 by Lee and Mary Wyatt Perdue against Arrena Wyatt widow of Joshua Wyatt. Mary Wyatt Perdue was the neice of Joshua Wyatt. Lee Perdue and Mary Wyatt married 30 May 1833 in Sumner Co., TN. Mary was born out of wedlock to Elizabeth Wyatt and James King. James King had given Joshua Wyatt (brother of Elizabeth Wyatt) $50.00 to hold in trust for his daughter. Joshua Wyatt loaned his sister Elizabeth and her husband Reuben Benson, Mary's $50 to buy land. They never repaid the loan hence the lawsuit. Harriet Wyatt Perdue second wife of Daniel Perdue father of Lee Perdue gave the above deposition for her cousin and against her deceased father's second wife Arrena Wyatt.
