All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/tn/tnfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Janet King JPerdue192@aol.com February 15, 2009, 11:29 pm Written: March 22, 1834 Recorded: February 24, 1835 Muhlenberg Co., KY Deed bk 8, pg. 162 This indenture made this twenty second day of March 1834 between Eli Perdue of the county of Sumner & State of Tennessee of the one part & Frederick Graddy of the county of Muhlenberg & State of Kentucky of the other part_Witnesseth that the said Eli Perdue for & in consideration of the sum of four hundred & fifty dollars to him in hand paid by the said Frederick Graddy the receipt whereof is hereby acknowledged have given granted bargained sold & confirmed & by these presents doth give grant sell & convey & confirm unto the said Frederick Graddy a certain tract or parcel of land lying & being in the County of Muhlenberg & State of Kentucky on the waters of the Cypress Creek & bounded as Follows: Beginning at a whie oak & cypress on the northside of Cypress Lake & running South 30 degrees East 130 poles crossing said Lake to a white oak, Black oak & poplar, thence South 36 degrees West 170 poles to a stake in a line of the original survey thence with the line thereof south 60 degrees East 128 poles to a Hickory & White Oak thence North 27 degrees East 30 poles to a White Oak & Hickory thence North 60 degrees East 45 polies to the beginning containing by estimation two hundreds acres be the same more or less To Have and To Hold the above described land & bargained premises with all & singular the Rights hereditments & appurtenances to the same belonging or in anywise appertaining to the only proper use benefit & behoof of him the said Frederick Graddy his Heirs or assigns forever And the said Eli Perdue for himself his Heirs Executors or Administrators will warrant & forever defend the title thereof to the said Frederick Graddy his Heirs or assigns against the title or claim of every person or persons whatsoever both in Law and Equity. In Testimony whereof the said Eli Perdue hath therunto set his hand & affixed his seal the day & year first above written Eli Perdue Commonwealth of Kentucky Muhlenberg County Sct I William H. C. Wing deputy clerk for Charles F. Wing clerk of the County Court for the County aforesaid certify that the deed of bargain & sale for Eli Perdue to Frederick Graddy was this day produced to me in my Office & acknowledged by the said Perdue a party thereto to be his act & deed Whereupon the said deed together with the foregoing certificate hath been truely recorded. Given under my hand this 24th day of March 1834 Wm H. C. Wing State of Tennessee Sumner County } This day appeared in open Court Sally Perdue who being privately examined before apart from her husband touching the Execution of the written Deed says that she executed the same freely of her own will without threats or coertion given her husband putative thereto given under my hand. 12 May 1834 State of Tennessee Sumner County Court May Term 1834 This deed of bargain & sale from Eli Perdue & Sally Perdue his wife to Frederick Graddy for two hundred acres of land lying in the County of Muhlenberg State of Kentucky was produced in open court & the said Sally Perdue privately examined by two members of the Court touching her execution of said deed & having acknowledged apart from her husband that she had executed the same of her own free will without threats or coertion of her husband Whereupon it is ordered by the court that said deed be certified under the seal of this court to the county & state aforesaid for Registration. In Testimony whereof I Alfred H. Douglass Clerk of said Court hereunto Set my hand & affix the seal of said court at office & in open court this 12 day of May AD 1834 & 58th year of American Independence. Commonwealth of Kentucky Muhlenberg County Sct I William H. C. Wing deputy clerk of the Muhlenberg County Court certify that the foregoing Indenture of Bargain & sale from Eli Perdue & Sally his wife to Frederick Graddy was this day produced to me in my office which together with the Testimonials thereon endorsed is admitted to & truly Recorded. Given under my hand this 24th Feby 1835 W.H.C. Wing Additional Comments: Eli Perdue was born ca 1790 in Franklin Co., VA to Meshack and Eleanor (Dillon) Perdue. He served in the Virginia Militia during War of 1812. He maried Sarah Sally Chitwood in Franklin Co., VA in 1815. They moved to Sumner County, TN ca 1828. They were parents of at least nine children.
