Chatham was formed from Orange County. 1790 Wilkes County, NC Morgan District listed John Thaxton 1 male with 4 females near Phillip & Wm. Johnston [24 July 1786 last will & testament of THOMAS JOHNSON, decd. proven oath by William & Phillip Johnson], Stephen & James Cobble, Wm. & Duk Medlin, James & Thomas Lorance, Charles & John Cate, Wm. Scott, Emanuel Ross, John Adams, John, Ben & Wm. Hammond, Robert King, Holbrooks, Wm. Blackburn, Willis Alexander. The 1800 census listed John Thaxton age 26-45, wife 16-26, 2 males under 10, 2 females under 10 & 0 slaves. It has been said that the first witness in a deed is from the husband's side and the next one is ALWAYS from the wife's side to protect her 1/3 dower right under the law. Lived Wilkes Co., NC where Deed Book A page 382 on 29 April 1783 between Jesse Toliver and Thomas Johnson for 40 lbs. 241 acres on Waters of Mulberry Creek near Round Top Mt. ..conditional line between Toliver and George Barker [GEORGE BARKER was born 1757 & served in the Rev. in NC but removed to Maury Co., TN where he lived in 1840] . Witnessed by Wm. & Alexander Johnson & JOHN THAXTON. In 1784 John Thaxton appeared on the tax list with one tithable and no acreage. In 1785 he was listed in Civil District 9 with 212 acres [later to be reported in error]. On 24 July 1786 it was ordered that JOHN THACKSTON be remitted tax on 212 acres he was unjustly taxed for in Wilkes County, NC. Deed Book D page 98 on 23 January 1788 between William Spicer and Stephen Caudill 100 acres on Roaring River adjoining where William Hodge lives. Witnessed by William Johnson, Thomas Caudill & JOHN THAXTON's X. In 1790 his home contained one male and 4 females next to RACHEL JOHNSON, widow of Thomas Johnson. JOHN Thaxton had two children named Thomas & Rachel. Deed Bk. Nothing will give greater clues to maiden names than the witnesses to old wills. In the lower left hand corner of most deeds, you will find signatures of two to four witnesses. The first is always from the husband's side. The next is almost always from the wife's side and that is to protect her one- third dower right under law. Mortgages: In the 1800s and before, it was traditional when the daughter married, as part of her dowry, for the father to either cover their mortgage or carry a note for his son-in-law. If you can find to whom their mortgage payments were made, 70% of the time it will be the bride's father. Patrick Napier born 1732 Goochland Co., VA died after 1808. He moved about 1776 to Montgomery Co., VA [out of which Giles Co. was formed]. His daughter SABRA born ca 1758 wed JOHN HAMMOND SR. about 1777 and moved from Giles Co., VA to KY in 1806 & in 1807 to Warren Co., TN settling at Thaxton. John Hamond Jr. wed Sallie Law dau. of William in Montgomery Co., VA on 8 August 1805 & moved to KY then to TN. SOME OF THE HAMONS WENT FROM WILKES CO., NC TO OWEN CO., KY. DANIEL O'REAR was born 1757 settled in Franklin County, TN & died 1839. An orderly Sgt. in the NC & VA during the Rev. & married to Susan Gouch. AARON PARKS wed Oney Stubblefield in Wilkes Co., NC 1784 & moved to Lincoln Co., TN 1816. He had 2 sons who married Johnsons & moved West to AK, TX & MO. He also had twins Aron & Ambrose. John Thaxton was still in Wilkes County, NC in 1800 with 2 white males under 10, 1 white male 26-45, 2 white females under 10 & 1 white female 26-45. On 3 February 1802 he and others were ordered to view and turn a road "where necessary from above CALLEB LOWES above the sliprey road ford to Wilkes Court House [Wilkes Co. NC Road Orders by Absher]. On 1 February 1803 William Lowe was road overseer in place of John Thackston. This is when he may have moved to KY. Possibly, OWEN COUNTY, KY where some of the Hammond family had moved to. Warren Co., TN 1812 tax list of John Hammons, Esq in the area of Viola [& later part of Coffee County] Henry, James, Peter & Archibald Blancett, Joseph, Jacob & William JOHNSTON, JOHN THAXTON, Abram Howard, Richard Price, Moses & John Rhea, James & Samuel Foster & Hamptons. The 1820 Warren Co., TN census listed on page 3 JOHN THAXTON over 45, female 26-45, 2 males under 10, 1 male 10-16, 3 females under 10, 1 female 16-26 with neighbors Wm. Lusk, John Grove, Flin Sellars, Thomas Vaughn, Joshua Hickerson, etc.. Warren Co., TN Plat Book I page 120 on 4 May 1825 John Blanks 18 acres entered 19 July 1824 #601 on Hickory Creek adjoining said Blanks & ___________ Thaxton to include a part of said Blanks improvement. Deed Book D page 368 17 April 1832 John Barnett, James Y. Barnett & Adam Young EXR of Robert Barnett decd. of WILSON COUNTY, TN to Thomas Thaxton 145 acres line between Jonathan Biles and said Thaxton being the premises whereon THAXTON NOW LIVES witnessed by W. Braly & Gan JOHNSON & Jonathan Biles. Proven 18 January 1823 registered 12 February 1823. Thomas Thaxton had married Sarah Boyd Barnett. The 1836 tax list of Civil District 8 John Thaxton 89 acres & 1 white poll; Wilburn Thaxton 50 acres & 1 white poll. The 1838 tax list of Civil District 8 listed John Thaxton with 161 acres with rental of 150 acres and Will Thaxton was taxed 1 white poll. The 1840 census on page 2 listed J. Where is he buried, who did he marry, and from where did he originate before KY? JOHN THAXTON JR. as born 1790-1800 with a wife and 1 male born 1835-40, 3 males born 1830-35, 2 females born 1825-30, 1 female born 1800-10, 1 female born 1760-70 & neighbors H. B. Cope, John H. Page 334 listed William Thaxton born 1810. John Thaxton & others, trustees of the Mt. Zion METHODIST meeting house, mentioned in a grant of land of the state. Bk. 3-290 on 5 March 1832 entry #3432 for John Ross 14 1/2 acres on Hickory Creek, NE corner of said Ross land, THAXTON'S several lines. Elijah D. Roach & Ansel Low, CC. Warren County, TN Deed 1838L page 343 John Thaxton Sr. to John Thaxton Jr. because J. Thaxton Sr. is old and infirm. Also mentions John Jr. to make deed of land to Wilbourn Thaxton. Dated 11 February 1835. Rutherford County. Crime: horse stealing. Sentence: three years and six months from 16 July 1840. Received 22 July 1840. He is 22 years old, 5' 9 1/2" high, weighs 128 lbs. Born and brought up in Warren Co., Tenn., eight miles south of McMinnville near the stage road to Huntsville on the waters of Hickory Creek, where his brother John Thaxton now lives. His father is very old and lives on the same piece of land with his brother. He has one brother in Rhea Co., Missouri, by the name of Thos. Thaxton, and follows farming. One sister in Gibson Co., Tenn., married to a man by the name of Robt. Ellison. Two sisters in Warren County, one married to a man by the name of Elisha Runnels, the other to James Ellison. Said Thaxton has uncles in Kentucky by the name of Brooks, but knows not what county. Said Thaxton has dark hair, dark eyes and dark sin. A tailor by trade. Has a small scar on the wrist joint of the left hand, also a small scar on the joint of the thumb where it joins the hand. He served his apprenticeship with Thos. F. Hicks. [Ledger 45, p. 204] p. 222. Martin Thaxton, age 22, born in Tennessee, occupation: tailor. Convicted of horse stealing by a court in Rutherford County, and sentenced to 3 years and 6 months in the Penitentiary. Received July 22, 1840 and discharged July 22, 1844. Notes: resentenced to 6 months. Number in ledger 86: 459. p. 252. Martin Thaxton, age 26, born in Tennessee, occupation: tailor. Convicted of attempting to escape by a court in Davidson County, and sentenced to 6 months in the Penitentiary. Received Jan. 22, 1844 and discharged July 31, 1844. Notes: conduct bad. Number in ledger 86: 702.
