William C. and William (Jr.) Wilhite to Jeremiah Whitson, 1874 H?. W. Willhite to Trust Deed Jeremiah Whitson We William C. Willhite and William Willhite, Jr. of the County of White & State of Tennessee have this day bargained and sold and do hereby transfer and convey unto Jeremiah Whitson of the County of Putnam & Sate aforesaid for the consideration of one dollar to us in hand paid, and the other consideration herein after named, the following described property, to wit: three horse mules, Sorrel colored, two black or dark brown colored mares mules and two bay colored horses, to have and to hold the Same to the Said Jeremiah Whitson his hears and assigns forever, But this deed is made for the following uses and trusts and for no other purpose, that is to Say, we are indebted to George Dowell in the sum of one hundred dollars by note due about 1st December 1873, and are also indebted to Whitley Terry in the sum of One Hundred Dollars due about 1 December 1873, and also H. J. Staggs in the sum of Six Hundred Dollars, which note was executed jointly by me and Said Jeremiah Whitson, but I am bound by agreement between us to pay off to said Joseph Dowell Said note of Six Hundred Dollars. (the dates of Said noes herein described to times when due may not be accurately described) and being desirous to secure the payment of Said noes and also to Secure and save harmless the Said Jeremiah Whitson as my Security as aforesaid and as my joint obligor as aforesaid according to our Said agreement have made this conveyance now it __shall pay off and ______ _____________ said Whitson may at any time thereafter proceed to sell & mules herein above described to the highest bidder cash at the Court House in Cookeville Tenn after advertised the time and place of the said sale Five public places at least twenty days in writing one of which shall be at the Court house in Cookeville and one at Sparta Tenn and apply the proceed of said sale first to the payment of the necessary expenses of this deed, secondly to the payment of notes herein named and thirdly to pay the ___ to us or to our order.
