I hereby authorize and empower you or either of you to celebrate to perform in the rights of Matrimony between Joshua Hickey and Mary Jane Jones of said county and join them together as man and wife, in the Holy Estate of Matrimony-Bond and Security having been given according to law. Hickey oath given State of Tennessee County of White Personally appeared before me A. Bussell a Justice of the Peace within and for the county and state aforesaid, Charlotte Montgomery a resident of White county State of Tennessee who being duly sworn according to law upon oath states that in the year 1852 she resided in Wayne County, Missouri, and lived a close neighbor to Joshua Hickey and Mary Hickey his wife and on or about the 25th day of June 1852 Thomas G. Hickey son of said Joshua and Mary Hickey was born. Witness states that she was not present at the birth of said Thomas G. Hickey but heard of it at the time and was at Hickey House and saw said Thomas G. Hickey in his mother’s arms and sucking his mother’s breast and she is satisfied that Thomas G. was born at time aforesaid mentioned. Witness states that both Joshua Hickey and Mary Hickey are dead and that there is no other person in this county present at the birth of said Thomas G. Hickey or lived a near neighbor to his parents at the time it occurred. Witness further states that she has no interest nor concern in the application of William Thomas as guardian for pension for the children of Joshua and Mary Hickey. Witness G. F. Hickey who was born April 1st 1854 and Mary Susan Hickey who was born Sept 25th 1858 and she further states that she has no interest nor concern in the application for pension made by William Thomas as guardian for the children of Joshua Hickey deceased. Goodwin and Sarah Jones residents of White County and state aforesaid who being by me duly sworn according to law and oath states that they were present at the birth of Edington McDonald Hickey son of Joshua and Mary Hickey. They state that said Edington McDonald was born on the eighth day of May 1856 and they further state that they have no interest nor concern in the application for pension made William Thomas as Guardian of the children of Joshua and Mary Hickey. Bussell a Justice of the Peace within and for the county and state aforesaid Catherine Dunn who being duly sworn according to law upon oath states that she follows the occupation of a midwife and in that business she was present at the birth of William Barrett Hickey son of Joshua and Mary Hickey who was born January 14th 1861. She further states that she has no interest or concern in the application for pension made by William Thomas as Guardian of the children of Joshua and Mary Hickey. Bussell a Justice of the Peace within and for the county and state aforesaid Martha A. Goodwin and Mary C. Goodwin residents of White County and state of Tennessee who being sworn according to law upon oath states that they were well acquainted with Joshua Hickey and Mary Hickey the wife of Joshua Hickey in their lifetime and that Mary Hickey died in White County on the 14th day of February 1863 of Typhoid fever. They state that they were present at the death of said Mary Hickey and that they have no interest nor concern in the application for pension made by William Thomas as guardian of the children of Joshua and Mary Hickey. A. Bussell J.P. for White County Pension declaration by William Thomas 28 October 1869 State of Tennessee County of Putnam On this 28th day of October 1869 personally appeared before me E. H. Stone clerk of the County Court of the county and state aforesaid. William Thomas a resident of District No. 8 County of Putnam, and state of Tennessee aged forty three years. Who being first, sworn according to law, doth on oath make the following declaration as guardian of the minor children of Joshua Hickey deceased in order to obtain the benefits of the provisions made by the Act of Congress approved July 14th 1862 and it’s amendments granting pensions to minor children under 16 years of age of deceased officers and soldiers, that he is the guardian of Thomas Gill who was born June 25 1852 Sophina Caroline who was born April 1st 1854 Edington McDonald who was born May 8th 1856 Mary Susan who was born September 25th 1858 William Barnett who was born January 14th 1861 Whose father was a private in company G commanded by Capt. Clift in the 5th regiment of Tenn. Vol. Cavalry in the war of 1861 and that the said Joshua Hickey died on or about the 29th day of October 1863. He was killed by guerillas in white county while out as a scout. That the mother of the children of aforesaid Mary Hickey the wife of the said Joshua Hickey died on the 14th day of February 1863. He further declares that the parents of his said wards were married in White County state of Tennessee on the 24th day of March 1847 by Alvey Bussell a Justice of the Peace. That he hereby appoints E. S. Williams of New Middle ________ his attorney with full power of substitution to procure for him as guardian of said minors from the United States such pensions as they are entitled to and to receive such certificates as may be issued for the same. Stone clerk of the county court of said county o hereby certify that William Thomas is the guardian to the following named minor heirs of Joshua Hickey decd. To wit: Thomas Gill Hickey, Saphina Caroline Hickey, Edington McDonald Hickey, Mary Susan Hickey and William Barnet Hickey that he was appointed at the June term 1869 of the county court of Putnam County by said court and entered into bond and security as such guardian. Stone Clerk Power of Attorney Articles of Agreement Know all men by these Presents: That I, Safiney Hickey child of Joshua Hickey late Private, in Company A of the 5th Regiment of tenn Cavalry Volunteers, in the war of 1861-1865, have made, constituted and appointed, and by these presents do make, constitute and appoint CHARLES & WILLIAM B. KING, of Washington, in the District of Columbia my true and lawful Attorneys for me, and in my name place and stead with full power of substitution and revocation, to prosecute my claim for minors Pension No. __________ hereby canceling and revoking all previous powers of attorney, if any have been heretofore given, in this case. Now this agreement witnesseth: That for and in consideration of services done and to be done in the premises, I hereby agree to allow my attorneys, CHARLES & WILLIAM B. KING of Washington, D. C., the fee of TWENTY-FIVE DOLLARS, which shall include all amounts to be paid for any services in the furtherance of said claim; and said fee shall not be demanded by or payable to my said attorneys, in whole or in part, except in case of the granting of my pension by the Commissioner of Pensions; and then the same shall be paid to them in accordance with the provisions of Sections 4768 and 4769 of the Revised Statutes, U. S.; AND I HAVE NOT PAID CHARLES & WILLIAM B. KING ANY SUM WHATEVER FOR THEIR SERVICES IN SAID CLAIM. My Post office address is Ditty Putnam County Tenn. D. 1892, we accept the provisions contained in the foregoing articles of agreement, and will, to the best of our ability, endeavor faithfully to represent the interest of the claimant in the premises; and we hereby certify that we have not received from the claimant above named any sum what ever as fee, and not exceeding one dollar for postage and other expenses. And that these agreements have been executed in duplicate without additional cost to the claimant, as required by law, in excess of the fee above named, the said attorneys making no charge thereof. Sir, considerable time having elapsed, since I have heard anything from the case of Joshua and Mary Hickey, dec’d in relation to the minor children for pension. I as guardian of the children of the above deceased have complied with all the requirements from your office that I have had notice of over two years ago, and have never heard anything from the case since and I now write you this letter to inform you that if there is anymore evidence required in the case to complete it you will please let me know what it is-so that I may be completed. The heirs is getting very impatient hoping that this may meet the welcome approbation of your mind and receive your earliest attention. Proof As to Service The Adjutant General U.S. A. reports name on rolls as Joshua Hickey, also the rank, company, and regiment, and the date of enrollments, muster and death as stated on preceding page. He also reports------------------------------ Proof As to Death 1st A.G. U.S. A. reports him on rolls for September and October 1863, Absent without leave since September 1863. Roll for November and December 1863, reports him captured and murdered by Guerillas October 29, 1863. M.O. Roll of Company, dated August 14, 1865 reports him killed in action November 29, 1863. Investigation fails to elicit any further information. Discrepancy as to date cannot be reconciled. Referring to the affidavits of Colonel W. P. Stokes and of Captain Joseph N. Blackburn, the adjutant General USA says: “The enclosed affidavits are not accepted as evidence that private Hickey was absent by lawful order when killed.” “Captain N. Blackburn, one of the affiants, was tried before a General Court Martial for having on or about October 1, 1863, without authority, quitted his command in the field taking with him several soldiers from their duty, of which charge he was found guilty.” “As it appears from his affidavit that Private Hickey was one of the soldiers he took with him, Hickey was properly reported as absent without leave by his company commander.” 2nd, 3rd, and 4th, none 5th W. P. Stokes late Colonel 5th Tenn County testifies that he was personally acquainted with soldier, that September 1863 a Scout was sent into Dekalb, Putnam and White Counties Tennessee, that soldier was with said Scout sent for the purpose of ascertaining what information could be learned of the enemy, and while on that duty (as reported to affiant by subordinate officer) he was captured by Guerrillas and by them shot in cold blood, about October 1, 1863, that soldier was on scout duty from September 13, 1863 up to the date of his death by authority of verbal orders from his commanding officers. Captain J. H. Blackburn, testifies that he had command of a scout which was sent into DeKalb, Putnam and White counties Tennessee in the fall of 1863. That soldier was under his command and was by him sent into White County on secret services and was captured by the Guerrillas and killed at or near Matlocks White County Tenn, in October 1863, that from September 13, 1863 up to the time of his death soldier was in the line of duty……….(rest of page illegible) Original Pension of Minor Children Thomas G. Jacob Barr. J. P. General Affidavit Tennessee county of Putnam In the Pension Claim of the Heirs of Joshua Hickey late of Co. A. 5th regiment Tenn Cavalry Vols., personally came before me, a Justice of the Peace, in and for the aforesaid county and State, Sarah Martin, who I hereby certify, is a respectable and credible person and who being duly sworn, declares in relation to the aforesaid claim as follows: Affiant says she was present and heard Captain Blackburn tell her father that he could stay at home and fix to get his children out of among the Rebels if some of the other boys would stay with him and David Barr staid, Samuel J. McCaleb staid, George Leaver staid, and his son staid with him and they was all killed the same time except S. J. McCaleb. Affiant says she knows the above facts by being present with her father at the time that he got the permission to stay at home the command being at that time as a scout in White County Tenn and being near Joshua Hickeys home affiant states further this affidavit was written in affiant’s presence and just as given out to W. A. McCaleb on the 1st Day of October 1893 at or Near Burton, Putnam County Tenn. She further declares that her post office address is Burton, County of Putnam, State of Tenn. M. G. State of Tenn county of Putnam personally appeared before me a Notary Public in and for the above state and county Thomas G. Hickey and in regard to the above described claim makes the foregoing statement that he is a son of the deceased soldier Joshua Hickey, that he was present at the time when his father Joshua Hickey wrote to Colonel Stokes and sent the letter by David Barr to send David Barr back to him with plenty of ammunition that the rebels had killed Cook Martin, Barr’s father in law last night which was on or about the 1st day of October 1863. Barr went and returned and heard no more complaint about ammunition and Barr and his father was killed about the last day of Oct 1863 and others at the same time and near the same place. T. G. Dear Sir, My father Joshuway Hickey who was killed in the war of the rebellion as private of Captain Blackburn’s Co. the regiment commanded by Wm. Stokes. The letter of Co. and No. of regiment not known to me. I understand that former application has been filed for the heirs of decent not by me. Now will you be so kind as to send me the number of said claim and the letter of company and number of regiment and also what be necessary in the further of said claim if it be a matter of proof send blanks for that purpose.
