County of White On the 14th day of January A. D. One thousand eight hundred and fifty one, personally appeared before me a Justice of the Peace within and for the County and state of aforesaid James Mitchell aged about fifty seven or eight years, a resident of White County in the State of Tennessee who being duly sworn according to law declares that he is the identical James Mitchell who was a private in the Company Commanded by Captain Abner Pierce, in a Separate Battalion of West Tennessee Militia Commanded by Col. William Woodfolk in the war with the hostile Creek Indians that he was drafted about the 8th or 10th day of August A. D. 1814 in White County Tennessee for the term of six months and was personally Discharged near Huntsville Alabama about the 16th day of March A. D. 1815, as will appear by the muster rolls of said Company, his original Certificate of discharge having been given to another man to draw his pay for the above specified service and he having never received it again. He makes this declaration for the purpose of obtaining the bounty land to which he May be entitled under the act granting bounty land to certain officers and soldiers who have been engaged in the military service of the United States passed September 28th 1850. his James X Mitchell Mark Sworn to and subscribed to before me this day and year above written. And I hereby certify that I believe the said James Mitchell to be the identical man who served as aforesaid, and that he is about the age above stated Robert Hitchcock Seal Justice of the Peace State of Tennessee County of White On the 23rd day of May A. D. One thousand eight hundred and fifty five, personally appeared before me a Justice of the Peace within and for the County and state of aforesaid James Mitchell aged about Sixty Two years, a resident of Putnam (formerly of White) County Tennessee Who being duly Sworn according to law declares that he is the identical James Mitchell who was a private in the Company Commanded by Captain Abner Pierce, in the Regiment of Tennessee Militia Commanded by Col Woodfolk in the War with the Creek Indians, His Regiment was ___mally styled Col Woodfolks separate Batallion, for the Term of Six Months And continued in actual service in said War for more than fourteen days, That he had heretofore made application for bounty Land under the act of 28 September 1850, And received a Land Warrant No (blank) which he has sold and legally disposed of And cannot now return; He makes this declaration for the purpose of obtaining the additional bounty Land to which he may be entitled under the act approved the 3d day of March 1855, He also declares that he has never applied for nor received under this or any other act of Congress, Any bounty land warrant except the one above mentioned his James X Mitchell Mark We Charles Meck and James R Herd residents of White County Tennessee upon our oath declare that the foregoing declaration was signed and acknowledged by James Mitchell in our presence and that we believe from the appearance and statements of the applicant that he the identical person he represents himself to be James R Herd C Meck The within Declaration and affidavit were sworn to and subscribed before me on the day and year above written, And I certify that I know the affiants to be credible persons, that the claimant is the person he represents himself to be, And that I have no interest in this claim Wm Clayton Seal Justice of the Peace State of Tennessee County of White I George G Dibrell Clark of White County Court hereby certify that William Clayton Esq whose genuine signature appears to the above certificate is now and was at the time of Signing the same an acting Justice of the peace a in and for the County and State aforesaid duly Commissioned and qualified that all of his official acts as such are entitled to full faith and credit In Testimony Whereof I have hereunto set my hand and affixed the seal of said Court at Office in Sparta the 25th day of May AD 1855 G G Dibrell Clerk of White County Court DECLARATION OF WIDOW FOR PENSION ACT OF FEBRUARY 14, 1871 State of Tennessee Putnam County SS: On this 26th day of April , A. D. one thousand eight thousand an seventy one , personally appeared before me, (1) Henry P Davis Clerk of the County Court of Putnam County a court of record, in and for the County and State aforesaid, (2) Sarah Mitchell , aged seventy seven years, a resident of 13th district in the , County of Putnam , and State of Tennessee ; who, being duly sworn according to law, declares that she is the widow of (3) James C Mitchell , who served the full period of sixty days in the (4) Military service of the United States in the war of 1812, and who was the identical James C Mitchell who (5) was drafted in Captain don’t recolect the Capt Name, No. of Co. or Regt Company, Regiment, Brigade, Division, at drafted Bunkers Hill White Co. , in the State of Tennessee on the don’t recolect day or month day of , 1812, and was honorably discharged at Fayetteville Alabama , on the Don’t know what day of the month , 1813; that (6) _her Husband James C Mitchell the Received Two Bounty Land warrants don’t know what dates or Number or under what acts (7) that she married under the name of Sarah Allison to said James C Mitchell on the 14th day of May 1814, by one Mr Armstrong J. P. at in White County in the State of Tennessee , there being no legal barrier to such marriage; that her said husband died at his Residence in Putnam Co Tenn , on the 25th day of August , 1863; and that she has not re-married since his death; that at no time during the late rebellion against the authority of the United States did she or her said husband adhere to the cause of the enemies of the Government, giving them aid or comfort, or exercise the functions of any office whatever under any authority or pretended authority in hostility to the United States; that she will support the Constitution of the United States; that she is not in receipt of a pension under any previous act; that she makes this declaration for the purpose of being placed on the pension-roll of the United States under the provisions of the act approved February 14, 1871; and hereby constitutes and appoints, with full power of substitution and revocation, CHARLES C TUCKER, of Washington, D. C., her true and lawful Attorney, to prosecute her claim and obtain the pension certificate that May be issued; that her Post Office is Laurel Hill County of De Kalb , and State of Tennessee ; and that her domicil or place of abode is in Putnam Co. Bartlett Lewis Medley Also personally appeared William E Bartlett , and Lewis Medly , both residing at in the County of Putnam , in the State of Tennessee , persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say: That they were present and saw (2) Sarah Mitchell the claimant (9) Make her Mark to the foregoing declaration; and they have every reason to believe, from the appearance of said claimant and their acquaintance with her, that she is the identical person she represents herself to be; that her husband, the soldier named in her declaration, died at or about the time and place stated therein, their knowledge of his death being derived from their Personal Knowledge and acquaintance with said deceased James C Mitchell and they know she had remained a widow since his death; that at no time during the late rebellion against the authority of the United States did she, or her husband, adhere to the cause of the enemies of the Government, or give aid or comfort; and that they have no interest, direct or indirect, in the prosecution of this claim. Tyrah R Roberson P. M. Laurel Hill Tenn Claim No 2879 Department of the Interior Pension Office Washington, D.C. Oct 27”, 1871 Sir: In claim No 2879, of Sarah Mitchell widow of James C. Mitchell for pension under Act Feb’y 14, 1871, a new statement of service is require which shall give the manes of the Captain or of the Colonel under whom soldier served. If bounty land warrant has been received the number thereof or of the application therefor should be stated. Please return this letter with the statement called for. Very respectfully, J H Barker Commissioner C C Tucker Present Laurel Hill Dekalb County Tenn November. The 21st 1871 Sarah Mitchell do hereby certify to the best of my recollection. Captain Pierce was the officer that my husband served under under as a soldier in the war of 1812. Also my husband received Bounty Lands in his life time. My recollection is the first was 80 acres but the second I do not recollect the number further I am not able to state what time said Bounty lands was received, but my recollection is that said claims was filed by Wm Jareal. Therefore I am unable to make any further statements relative to the case as my recollection is very tainted caused by my old age. her Sarah X Mitchell mark Witnesses Richard Heer W E Bartlett State of Tennessee White County I F M SIMS Clerk of the County Court of said County hereby Certify that I have made diligent search for marriage License in my office of the date of 1812 & later date and I have not been able to find any Marriage record futher back than 1837 and I futher certify that I have been informed by creditable Men that some of the Books and a great many of the papers have been destroyed belonging to this office have been destroyed belonging to this office during the late War. Given under my hand and Seal of said Court at office the 2d day of November 1872 F M Sims Clerk of White County Court State of Tennessee This day came before me the under signed authority, Putnam County Joseph Allison and Frances Allison persons who I certify to be respectable and entitled to full faith and credit, after being duly sworn on their oaths according to law State they are intimately acquainted with Sarah Mitchell widow of James C. Mitchell and have been for a number of years, further State the parties above named was maried in the county of white and state afore said, on the 14th day of May 1814, further state their facilities of knowing the facts from personal knowledge was they was present at the mariage which was executed be Armstrong, Esq, who has since died, further state from personal knowledge they knew the parties above named to have lived and cohabited together as husband and wife form state of mariage untill the death of James C Mitchell, further state their ages is Joseph Allison seventy three and Frances Allison Eighty years old, further state their post address is Cookville Putnam County Tennessee and further say they have no interest in said claim, direct or indirect. Witnesses his William E. Bartlett Joseph X Allison Barnett Harrison mark her Frances Allison mark Sworn to and subscribed before me on this the 4th day of November 1872 and I certify that contents was read and explained before assingning and I further certify I have no interest in said claim for a pension.
