Will of Benjamin Willhite, son of Reuben and Mary Yager Willhite, of White County, Tennessee. From microfilm, copied in 1997, and transcribed by Sandra Vines. Benjamin Willhite Will I Benjamin Willhite of the County of White and State of Tennessee being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and for the following that is to say I give and devise to my beloved wife Nancy C Willhite one sorrel horse named buck and I also give my wife on waggon and yoke of oxen and also one cow and calf and I also give my wife all my household and kitchen furniture and if my wife nancy should marry the household and kitchen furniture      (unable to read) to be equally divided between my children to wit my son Stephen and daughter Catherine Anderson and my son Benjamin F and my son Vance and my son Solna and in case my beloved wife should not  marry I want at her death the household and kitchen furniture to be equally divided between my four children here in above named.  I also give to my daughter Catherine Anderson two head of of horses one is a sorrel filly four years Old last spring and one year old bay mare colt and also one white  ?? two year old steer.  I give to my son B F Willhite two head of horses to wit one bay mare called  Ruf (?) and one bay  horse colt two years old last  (blank)  I give to my son Solna Willhite one gray horse colt one year old last spring and one suckin colt--- I Benjamin Willhite do give to four of my sons to wit son  my Stephen and my son Benjamin F my son Vance and my son Solna . I give and bequeath to four of my sons here above  named all of my hogs and all of my cattle only the cow and calf and oxen which I have disposed of in my will and I also give all my farming tools to the said four boys herein named to have and to hold.  I give and bequeath to my four sons and daughter Catherine Anderson my son to wit Stephen Willhite and my son Vance Willhite and my son Solna Willhite.  I give to the five children herein named the use of the farm until the youngest child becomes to be twenty on years of age by their giving my beloved wife a decent support during her widowhood in her natural lifetime and in case they refuse to give her a support then enough of the land is to be laid off for her use to rent when cultivated for a support during her widowhood of lifetime.  I give my daughter Catherine Anderson the negro girl Jane at a fair valuation of the said negro should live until the youngest child to wit Solna is twenty on years of age.  I Benjamin Willhite do herein case the said negro girl should not live then my daughter Catherine Anderson is to have an equal lot of my home land where I now live upon layed off for her lot but in case the said  negro girl lives then I give to my four sons my homestead place to be layid off in equal lot between my four sons to wit Stephen Willhite  and my son B.F. Willhite and my son Vance Willhite and my son Solna Willhite for them to have and to hold-- I Benjamin Willhite do give  the present crop  ??  on the farm this year to my four sons to wit my son Stephen and my son B.F and my son Vance and my son Solna to have and to hold.  I Benjamin Willhite give to my two sons to wit my son John Willhite and my son Stephen Willhite my mill and land belonging to the mill seat by them paying Catherine Anderson my daughter  one hundred dollars in two years after my decease and also pay my son Daniel Wilhite one hundred dollars in two years after my decease and also pay the three minor son to wit B.F and Vance and Solna Willhite two years after my decease and the money to be put at interest until they become twenty one years of age and then to be payed over with the interest to each heir to have and to hold forever. I Benjamin Willhite do hereby ?? and appoint my  trusty friend James C Kelly and my son John Willhite and my son Stephen Willhite my lawful executors to all interest and purposes to execute this my last will and Testament according to the lone intent meaning of the same and every part and clause thereof hereby ?? and declaring utterly void all other wills and Testaments by me heretofore  made.  In writing whereof I the said Benjamin Willhite do here unto set my hand and seal this July 2th  day of our Lord 1862.           Signed and sealed in the presence of the said    Benjamin Willhite (seal) Benjamin Wilhite at his request as witnesses to my last Will and Testament Idell Stone James Stone
