Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ************************************************************************ Wilson County, Tennessee Deed Book K, p. 288 This Indenture this twenty first day of October in the year of our Lord one thousand eight hundred & twenty three between the legatees of Barnaba Eagan deceased to wit James Eagan, Thomas Dillon & Margaret Dillon his wife, Hugh Eagan, Lydia Green, Barnaba Eagan,Rachel Tipton, Samuel Motheral guardian for the heirs of William Eagan dec'd, Henry Howel & Polly Howel his wife, Jesse Eagan all of the County of Wilson & Cocke and State of Tennessee of the one part and John Eagan of the County of Wilson and State of Tennessee of the other part, Witnesseth that we the said legatees of the said Barnaba Eagan deceased for and in consideration of the sum of four hundred and fifty five dollars to the said legatees of the said Barnaba Eagan decd in hand paid by the said John Eagan before the sealing and delivering of these presents the receipt whereof is hereby acknowledged hath bargained and sold & by these presents do bargain sell convey and confirm unto the said John Eagan his heirs and assigns a certain tract or parcel of land containing sixty five acres lying & being in the County of Wilson on the waters of Spencers Creek. Beginning as follows to wit, on the south boundary line of a six hundred and forty acre tract granted to Peter Seiver nine and a half poles east of the beginning corner of a two hundred and seventy four acre tract granted to David Shelby at a stake running west with Luryes line eighty poles to a stake thence south one hundred and thirty poles to Hendricks north boundary line ... ... elm thence East with said line eighty poles to a stake on John Stewarts west boundary line it being part of the said two hundred & seventy four acre tract granted to the said Shelby Thence north one hundred and thirty poles to the Beginning, containing sixty five acres be the same more or less to have and to hold the above mentioned premises with the appurtenances there to belonging with all and singular the benefits and emoluments thereto & there from to arise unto the said John Eagan his heirs & assigns to his only only use forever and the said legatees of the said Barnaba Deced of them selves & their heirs executors & administrators doth hereby covenant grant and agree to and with to and with the said John Eagan, his heirs & assigns the said land with all & singular the premises and appurtenances before mentioned unto the said John Eagan his heirs and assigns free from the claim of our selves our heirs & all person or persons claiming under whatsoever shall and will warrant and defend by these presents forever in witness whereof the said legatees of the said Barnaba Decd hath hereunto set their hands & affixed their seals the day & year first above mentioned.
