Although he was from Wilson County he directed that the will and settlement be transferred to Williamson County. JOHN L. HILL Deceased Will June Term 1856 In the name of God Amen. I JOHN L. HILL of the county of Wilson and State of Tennessee do make and publish and ordain this as my last will and testament. Hereby revoking, annulling and making void all other wills by me at any time made. Item 1st I direct that my executor hereinafter named, be and he is hereby authorized to sell all my property both real and personal (except my beds and bed clothing, my saddle horse and wife's saddle, which I give to my wife, ANN) and my said Executor will use his own discretion in either selling privately or publicly my land and Negroes and for cash or upon credit as he shall think best to advance the interest of my estate; the residue of my property to be sold as the law directs and out of the proceeds of such sale, or any money which may be due me from other sources, I wish all my just debts paid. Item 2nd It is my will that one third of the funds which shall remain after my estate is settled up (unless another child should be born until me of my said wife ANN) and in that event one fourth of such funds, shall be lent out from year to year and the interest, paid annually to wife Ann, during her life or widowhood. My executor is directed to manage said one third or one fourth if he will do so or such other person as he may choose whenever he may feel disposed to be relieved of the burden. Upon the death or marriage of my said wife the fund so directed to be lent out for her use is to become the property of my two children ROBERT HILL & THOMAS HILL and such other child as may be born to me of my said wife should any such be born. I wish my Executor to act as guardian for my children and have charge of whatever money or property they may have being the other two thirds or three fourths of funds after settling up of my estate as the case may be. In the event that one of my children shall die in their minority and without children, I wish the other or others as the case may be to take the entire estate and in the event of the death of both or all of my children in their minority and without childr4en then and in that case, I wish my brothers and sisters to have and take said property. Item 3rd I wish my children to be well educated and request special attention in that respect. Item 4th In the event that my wife shall dissent to the above disposition of my property (to which she now assents) then I wish the balance after her share shall be set about to her to remain under the arrangement as above set forth, she to be charged one hundred & fifteen dollars for the horse heretofore given to her. Item 5th My knee buckles, sleeve buttons (being heirlooms) I give to my brothers as they may settle and agree. I direct that all my estate be transferred to Williamson County and settlements made under the court of said county according to law, as soon as the same can conveniently be done, if any executor or the guardian of my children shall so desire. HILL, late of the county of Wilson, was produced in open Court and fully proved by the oaths of John H. Hessey and R. P. Lumpkin subscribing witnesses to the same and was ordered to be recorded as the last will of the deceased. BUCHANNAN 75.00 The hire of a hired Negro bal of the year by Exec 7.25 $3878.25 In a former settlement he received credits for vouchers produced and allowed from inclusive amounting to 1,991.15 Leaving in his hands due 1st January 1853 $1,187.10 Interest on this sum to 1st June 1855 2 years & 5 months 273.62 And the further sum 2nd & last payment on slaves 17 Sept 1853 547.50 Int on this last sum 20 1/2 months to 1st June 1855 55.42 $2,763.64 He reports now that he has sold the land at private sale for $1,200. S. McClain, Clerk of Wilson County Court The State of Tennessee, Williamson County Court June Term 1856 WILLIAM H. S. HILL, Executor of JOHN L. HILL deceased and testamentary guardian for his children, produces to the Court here, a certified copy of the last will and testament of the said JOHN L. HILL deceased, with a copy of his settlement as such Executor with the clerk of the Wilson County Court, from which will it appears that said executor has the right, at his own option, to remove said guardianship to this county and qualify as surety guardian here, and having expressed his desire to make such removal. It is therefore ordered that said removal be made and that said last will and testament and settlement be recorded and therefore WILLIAM H. S. HILL is appointed guardian for ROBERT HILL and THOMAS HILL, minor orphans, who gives bond in the sum of five thousand dollars with THOMAS HOLT and ROBERT F.
