Submitted by ************************************************************************ The following are three deeds prepared from 1879 to 1919 on a singular piece of property located on the Micah Andrews survey. Along with the three deed transfers described below, this land was further divided, in the 1970's, to the surviving 5 children of J. A. and Mary New: Beatrice New Plant, Howard Leslie New, Luther New, Wilburn New, and Berniece New Lunday Boyd. In 1992, Howard New deeded his part to his daughter and son-in-law, Tamra and Michael Owen. In 1996, Wilburn New sold his part to Boyd and Melodie Purdue (no family relation). In 1998, Berniece New Lunday Boyd sold her part to her son Clay Lunday. Tamra New Owen is the Granddaughter of James Alfred and Mary Willie (Wolf) New (paternal side) and the Great Great Granddaughter of Louis and Martha (Kelly) Tiner (maternal side). *************************************************************************** Bastrop County Deed Records, VOL Z, page 313: The State of Texas, County of Texas Know all men by these presents that we J. C Higgins and C. B. Garwood of the county and state afore said, for and in consideration of the sum of one hundred and twenty five dollars to us in hand have, by Louis Tiner of said county and state, and for the further consideration of his two certain promissary notes for sixty two 50/100 dollars each of ever and all herewith payable on the 1st of January 1881 and 82 respectively the weight of said cash and notes is hereby acknowledged, have granted, bargained and sold, unto the said Louis Tiner, all of our right, interest and claim, in act to the following described tract of land. Lying and being situated in the West side of the Colorado river, in said county and state, and on the waters of Bright's Piney and being one hundred acres of land, out the Michael Andrews headright, conveyed by William Shaw to F. W. Dabney and from Dabney to E. C. Shaw, and by the Sheriff of said county as, and by us conveyed to Jno. C. Wilson, and reconveyed to us by the said Jno D. Wilson, all of said conveyances are of record in said county in the county Clerks office in Bastrop. It is expressly understood that a *** of lien is hereby retained in the above described *** and promises, for the payment of the two notes afore mentioned for sixty-two 50/100 dollars each. To have and to hold all singular the above described tract of land with all and singular the rights, m****, hereditaments and appurtenances unto the said Louis Tiner, his heirs and assigns forever. And who the said J. C. Higgins and C. B. Garwood, do hereby agree to warrant and forever defend the title to above described land and premises unto the said Louis Tiner his heirs and assigns and against the claim or claims of any and all persons claiming and to claim the same on ** ** thereof- In witness whereof I have hereunto set our hands and scroll seals, this the 20th day of December A. Tiner and wife, Martha Tiner of the County of Bastrop and State of Texas, for and in consideration of the sum of Seventeen Hundred and Fifty ($1750.00) Dollars, cash in hand, the receipt of which is hereby acknowledged, have Granted, Sold and Conveyed, and by these presents do Grant, Sell and Convey unto W. R. Searcy, of the County of Dallas, State of Texas, all that certain tract or parcel of land, situate, lying and being in the County of Bastrop, and State of Texas, a part of the Micah Andrews Original Survey, described by metes and bounds as follows: Beginning at a stone corner in the East line of the W. M. Hess 172 acre tract, same being the S. W. corner of a tract of 100 acres sold by Young and Rosanky to B. D. Merritt: Thence S. 10 W. with Hess's line 572 vrs to his corner with Farris and continuing with Farris 808 varas in all to a rock at the NW corner of the Nott 66 acre tract; Thence East with the N. line of the Nott tract 531 varas to the NE corner of same in the center of Bright's Piney creek, and continuing East with a line of Deloach's land, 650 varas in all to a corner with Deloach; Thence N. 10 E with another line of Deloach's land 808 varas to a corner with him on Marritt's S. line; thence with Merritt's line West recrossing Piney Creek 650 varas to the point of beginning, containing 91.6/10 acres of land, as surveyed by C. L. Moncure, Surveyor on the 15th day of November, 1919. This being the same land sold and conveyed to the said L. T. or Louis Tiner by Higgins and Garwood, by deed of date Dec. 27th, 1879, as shown by deed duly recorded in Vol. Z, page 313 of the Deed Records of Bastrop County, Texas, said land being therein described as 100 acres, more or less, to which deed reference is here made for more definite information. TO HAVE AND TO HOLD unto the said W. R. Searcy, his heirs and assigns forever, together with all and singular the rights and appurtenances thereto in anywise belonging; and we do hereby bind ourselves, our heirs, executors and administrators to Warrant and Forever Defend all and singular the said premises unto the said W. An the said Martha Tiner, Wife of the said L. T. Tiner, having been examined by me privily and apart from her husband, and having the same fully explained to her, she, the said Martha Tiner acknowledged such instrument to be her act and deed, and declared that she had willingly signed the same for the purposes and consideration therein expressed, and that she did not wish to retract it. Searcy, a widow, and Thomas J Searcy and Anabel Searcy Couch and husband, Robert L. Couch, acting herein by and through Mrs. Lizzie D. Searcy, our agent and attorney-in-fact, of the County of Dallas, State of Texas for and in consideration of the sum of Fifteen Hundred and No/100 ($1500.00) Dollars, to us paid, and secured to be paid, by J. A. New and wife, Mrs. Mary New, as follows: The sum of $750.00 to us cash in hand paid, the receipt of which is hereby acknowledged, and the execution and delivery by the Grantees herein of their promissory note of even date herewith in the principal sum of $750.00, payable to the order of Mrs. Lizzie D. Searcy, bearing interest at the rate of six per centum per annum, payable semi-annually, on January 1, 1948, and the first day of each January and July thereafter until said note is fully paid, the principal thereof being payable in semi-annual installments of $50.00 each, the first installment being due on or before January 1, 1948, and the remaining installments being due on or before the first day of each January and July thereafter until said note is fully paid, such note being payable at the office of the First State Bank of Smithville, in Smithville, Texas, containing the usual clauses as to interest on past due interest and attorney's fees, and additionally secured by deed of trust of even date herewith from the Grantees herein to R. A. Ritchie, Trustee, have Granted, Sold and Conveyed, and by these presents do Grant, Sell and Convey unto the said J. A.
