W. Ezell and wife F. E. Ezell of the County of Bell and State aforesaid, in consideration of the sum of ($1.00) ~~~~~ one Dollars, to us in hand, paid by H. B. Rogers, and the further consideration of adjusting the boundary lines of two tracts of land owned by the said Rogers and ourselves, the division line between which tracts has here to fore been incorrectly surveyed. Have Granted, Sold and Conveyed, and by these presents do Grant, Sell, and Convey unto the said ~~~~~~~H. B. Rogers~~~~~~~~~~~~ Of the County of Bell and State of Texas, all our rights title interest and claime in and to all the land lying north of a line beginning S. 19 degrees W. 610 vrs. From the N. E. corner of the E.B. Reed 320 acre survey out at a stone from which an Elm tree marked X vrs. N. 40 degrees W. 41 vrs. Thence N. 71 degrees W. 57 vrs. To a stake and pile of rocks from which a post oak marked X vrs. N. 21 degrees E. 37 vrs. And a Post Oak marked X vrs. N. 11 degrees E. 30 vrs. Xxxx being the intention of xxxx xxxxx xxxx to leave to said Rogers 62 1/2 acres in the N.E. corner of said E. B. Reed survey, conveyed to said Rogers by N. J. Hefner and wife~~~ conditioned nevertheless that nothing in this instrument shall be construed to convey from us any land included in a proper and accurate survey of our 92 1/2 acres in the S.S. corner of said E.B. Reed Survey. To Have And To Hold the above described premises, together with all and singular the rights and appurtenances thereto belonging, unto the said H. B. Rogers, his heirs and assigns, forever. And we do hereby bind our heirs, executors and administrators to Warrant and Forever Defend, all and singular, the said premises unto the said H. B. Rogers his heirs and assigns, against every person whomsoever lawfully claiming or to claim the same, or any part thereof, by through, or under us, and no xxxxxxxxxx. Ezell both of them known to me to be the persons whose names are subscribed to the foregoing instrument, and acknowledged to me that they executed the same for the purpose and consideration therein expressed. And the said Fannie Ezell, wife of the said D. W. Ezell having been examined by me privily and apart from her husband, and having the same by me fully explained to her, she, the said Fannie Ezell, acknowledged such instrument to me to be her act and deed, and she declared that she had willingly signed the same for the purposes and consideration therein expressed, and that she did not wish to retract it.
