A. Harrell, / In Probate Court of Bell County, Deceased. No. 2090 / Texas. To August Term, A. D. 1925 To the Hon. J. W. Sutton, Judge of said Court: - Now comes W. W. Hair, attorney for Mrs. Mary Harrell, applicant in this cause for probate of will of her deceased husband, J. A. Harrell, and would show the court: - That heretofore, to-wit, at the April Term, 1925 of this Court and one the 4th day of May, 1925, the last will and testament of the said J. A. Harrell, was duly proven up in this court by the attesting witnesses thereto, and written proofs of said will were on said date duly executed, signed and sworn to in open court as will appear by the attached proofs of will; that on said date, to-wit: May 4th. 1925, a decree probating said will and appointing appraisers of said estate was drawn by attorneys in the case, a notation being made on the trial docket by the court on said date supporting or authorizing said decree and said will was duly admitted to probate. That through inadvertence and oversight neither the proofs of will nor the decree probating said will and appointing appraisers was recorded and spread upon the minutes of this court during said April Term, 1925 of said court, and which minutes for said term have heretofore been closed and finally approved and signed by the Court. Wherefore, petitioner prays that the court grant at this time an order authorizing and instructing the clerk of this court, to enter “nunc pro tunc” as of said date of May 4th. 1925, each and all of said proofs of will and said decree probating said will and appoint Appraiser and that same be spread upon the minutes of this court, and for general relief.
