Finley NOTE: LOT 6 State of Texas {} County of Bosque{} Know all men by these presents that we, W.R. LUPTON and BETTIE H. LUPTON, his wife, of the Village of Kimball, State & County above named, in consideration of the sum of Eleven Hundred & Fifty Dollars to be paid to W.R. Lupton by WALTER TIMMS of the said State & County as follows to wit: Six Hundred Dollars on the execution of these presents, Two Hundred Seventy-five Dollars on the twenty fifth day of December A.D. 1874 and Two Hundred Seventy-five Dollars on the first day of July A.D.1875 of which said sums the said Walter Timms agrees to make punctual payment when due and has given his two promissory notes for $275. each with interest at ten percent per annum to accrue the payment of the last two installments of said sums agree to sell unto the said Walter Timms all that certain piece or parcel of land situate in the Village of Kimball, County & State aforesaid and described as Lot number six (6) in Block number sixteen (16) of said Village of Kimball together with the dwellings & shops situated thereon, the tools, machinery &implements, material & unfinished work appertaining to said shop and all and singular the tenements hereditaments and appurtenances to the said premises belonging and we further agree for ourselves, our heirs, executors & administrators that upon receiving the first two installments of the purchase money of said premises at the time and in the manner aforementioned to wit, the sum of Six Hundred Dollars stipulated to be paid upon the execution of these presents and also the sum of Two Hundred & Seventy-five Dollars with interest stipulated to be paid on the 25th day of December 1874 (The note given for the amount of the final installment being secured by Mortgage in this premises) We will execute and deliver to said Walter Timms, his heirs and assigns a good and sufficient Warranty Deed for the conveying and assigning to him, the said Walter Timms, the fee simple of the premises hereinbefore described free from all incumbrances and the said Walter Timms is to have immediate possession of said premises. In witness whereof we have hereunto set our hands and scrolls (for seals)this 13th day of August A.D. 1874. In presence of {} W. R. Lupton Bettie H. Lupton The State of Texas {} County of Bosque {} Before me W. A. LUCK , a Justice of the Peace and exofficio Notary Public in and for Bosque County, Precinct No. 2, personally appeared W. R. Lupton and Bettie H. Lupton, wife of the said W.R. Lupton, both to me well known, who acknowledged that they had executed the foregoing conveyance for the purpose and considerations therein stated. Also Bettie H. Lupton upon a private examination and apart from her husband and having had the said conveyances fully explained to her, declared that she had willingly executed the same without any fear or compulsion on the part of her said husband and that she wished not to retract it.
