Estes applicant and O.F. Wilson and A.B. Wilson witnesses, to me well known, who being duly sworn according to law, declare that she the said Minerva J. Estes is Bona Fide settled upon vacant public domain. The same described in the accompanying file under "An Act for the benefit of actual ocupants of the Public Lands," passed May 26, 1873, and that she has not a homestead. Minerva J. Estes O.F. Beginning at a point viz: S.E. Cor of a tract filed upon by Warren Allard and on north line of James House survey. Thence North with Allard's line to S. line of J.M.Reyna Survey. Estes, it being the quantity of land to which she is entitled by virtue of an affidavit made in accordance with Art. 3939 and 3940 Revised Statutes. Said Survey is No. 1282 in Burnet County, Texas, situated on the waters of Yancy Creek, a tributary of Colorado River, about 20 miles N. 27W of the town of Burnet. Beginning at the N.E. cor. of the Warren Allard Sur. a St. ...(see above description) Surveyed October 7th 1881 O.S. Sellers A. Brown Chain Carriers I. T.A. Chamberlain Survey of Burnet County, Texas, do hereby certify that the foregoing described Survey was actually made by me on the ground, according to law, on the date and with the Chain Carriers aforesaid, duly qualified, and that all the Corners, Lines, Boundaries and Marks of the same, whether natural or artificial, are truly described and set forth in the foregoing Plat and Field Notes, and that they are recorded in my office in Book 7, page 23. Chamberlain (next page) PROOF OF SETTLEMENT UNDER HOMESTEAD ACT The State of Texas County of Burnet Before me, the undersigned, authority in and for the County aforesaid, this day came and personally appeared M.J.Estes, a resident citizen of said County, who being by me duly sworn, declares that she is a bona fide settler upon 58 acres of vacant Public Land, situated in said County, and surveyed for her on the 7th day of October 1881, by T. A. Chamberlain, a Surveyor of said County; that she has occupied and improved the same as a Homestead for a period of three consecutive years, beginning on the 29th day of April 1881, that she is the head of a family, and that she makes this affidavit for the purpose of obtaining a title to the same for a Homestead, under "An act for the Benefit of Actual Occupants of the Public Lands," approved May 26th, 1873, and Acts prior and subsequent thereto; and that she has not a Homestead other than the above. And also at the same time came and personally appeared J.M. Patterson and J.C. Patterson, two credible resident citizens of said County, to me well known, and who being duly sworn, depose and say that M.J. Estes the person first above named in this Affidavit, has actually settled upon and cultivated as a Homestead the land survey for her on the 7th day of October, 1881, by the surveyor aforesaid, for the period of three years, and they nor either of them have any interest in the said land. /s/ M.J.
