Tabor, Lula Harvey, wife of M.E. Harvey, Anna Ransberger, wife of Walter Ransberger, Joe Brooke and Jim Brooke, Consideration, set out in full below, The State of Texas } County of Freestone} Before me, the undersigned authority on this day personally appeared Burley Brooke proven by the oath of W.S. Hall to be the person whose name is subscribed to the foregoing instrument and acknowledged to me that he executed the same for the purpose and consideration therein expressed, Given under my hand and seal of office this the 5th day of March A.D. 1910, (L.S.) J.R. Grogg Notary Public in and for "Leon County", Texas, Whereas, in the settlement of the estate of I.R. Brooke (Ignatious Roger) deceased, it was agreed that all the lands belonging to said estate situated in Coleman Co., Texas, should be the property of Mrs. E.P. Brooke, wife of J.G. Brooke, deceased, and, Whereas, in compliance with said agreement J.F. Trahin and wife Sophia Trahin and Robert Epps and Willie Epps formerly wife of R.T. Brooke deceased, executed a deed of conveyance conveying all the lands situated in Coleman Co, Texas, that were set a part for the heirs in their first settlement to Mrs. E.P. Brooke, wife of J.G. Brooke deceased, was dated May 21, 1889, and is recorded in Vol. W page 294, deed records Coleman Co., Texas, and whereas, Burley Brooke a son of Roger Brooke, deceased, and Willie J. Brooke, was at the time of the execution of said instrument a minor, and therefore did not execute said instrument, at that time, and whereas, he received as his share of the said estate certain interest in lands and property in other parts of Texas, than Coleman Co., in the division of said estate, and, Whereas, it is desired that he execute a deed of relinquishment in order to make the record title clear, to the land situated in Coleman Co., Texas, to set a part to said Mrs. E.P. Brooke, and the said Mrs. E. P. Brooke is now dead, and her devisees under the said will and her sole heirs are Allie Tabor, wife of D.S. Tabor, Lula Harvey, wife of M.E. Harvey, Anna Ransberger, wife of Walter Ransberger, Joe R. Brooke, and Jim Brooke. ... , all residents of Coleman Co., Texas, Now therefore, in consideration of the premises and in order to effectuate the said agreement hereinbefore recited and in consideration of the relinquishment by the said heirs of the said Mrs. E.P. Brooke, deceased, of their interest in property located in other parts of the State, that was set a part in the division to me, and the other heirs exclusive, of Mrs. E.P. Brooke, I the said Burley Brooke of Freestone County, Texas, have sold, conveyed, quit-claimed and released and do by these presents sell, convey, quit-claim and release and acquit unto the said Allie Tabor, wife of D.S. Tabor, Lula Harvey, wife of M.E. Harvey, Anna Ransberger, wife of Walter Ransberger, Joe Brooke, Jim Brooke, heirs and devisees of Mrs. E.P. Brooke deceased, of Coleman Co., Texas, all my right, title and interest in and to that certain 160 acres of land situated in Coleman Co., Texas, and known as survey No. 42 on the waters of Jim Ned Creek.
