Kingsbery - Will Published in the Democrat-Voice, Coleman County, Texas 1929 Kingsbery Will In Own Handwriting Names No Executor Property with probate value of $50,000 divided equally The last will of the late H. W. Kingsbery of Santa Anna will be filed for probate by Critz & Woodward. The document is written in the deceased’s own handwriting and disposes of an estate with a probably value of $50,000. The will proper is dated July 14, 1926, and a short codicil Jan. 2 1929, and no executor is named in either. Mr. Kingsbery died Jan. 4. In the application for probate the court will be asked to appoint Howard T. and Carroll E. Kingsbery administrators of the estate. The character of Mr. Kingsbery and the life he lived, are better reflected in three commandments left his children than can be painted with words by friends, and for this reason the Democrat- Voice asked permission to publish the will in full. The commandments appear at the bottom of the will and are unusual. The will: State of Texas, county of Coleman --- Know all men by these presents that I, H. W. Kingsbery of said Coleman county, Texas, mindful of the certainty of death and desirous of settling my worldly affairs, and making proper disposition of my property, to the best of my ability, I do here, and by these presents, make, and declare, this my last will and testament. I desire and direct that all my just debts be first paid out of my personal property and estate, and a sufficient amount of my Woodman policy be used to pay for my burial expenses and the probating of my will, the remainder to be equally divided between my wife, Cora B. Kingsbery, Howard and Carroll Kingsbery and Merle Woodward. I bequeath will and direct, that my wife shall have absolute charge of my home and its contents and an amount from the estate to pay for her supplies, together with the amount of three hundred dollars cash annually. I bequeath, will and direct that she have the northwest corner lot and new bungalow on block 31, Santa Anna, Texas. I bequeath, will and direct to my son, Howard F. Kingsbery, three hundred and two acres (more or less) out of the Wm. Farris survey and three hundred and thirty-three acres (more or less) out of the Wharton county school land. These two tracts of land are situated about one mile west and southwest of my residence, in Coleman count, Texas. To my daughter, Merle K. Woodward, I bequeath, will and direct, six hundred and five acres of land out of the J. A. H. Cleveland survey, including all the field in cultivation. To my son Carroll E. Kingsbery, five hundred and twelve acres of land (more or less) out of the Wharton county school land, situated in Coleman county, Texas, known as my home place. Also ninety-two acres of land out of the H. A. H. Cleveland survey, to-wit: Lying north of the field now in cultivation and adjoining the Wharton county school land to the north line of my said Cleveland tract; thence east, with north line of said survey to a point, opposite a point on north line of field fence to make the nine-two acres north and south lines to be of equal length. If oil, gas, or mineral of any kind is found on any of my land in paying quantities, I bequeath, will and direct that the profits be equally divided between my three children. The one-sixth undivided interest I won in one hundred and thirty-two acres (more or less) of land, known as the East Santa Anna Mountain, together with the residential property and vacant lots, and a vacant lot, No. 6, block 79, in Sulphur, Okla., together with the cattel, mules and horses, I think best to dispose of in the payment of my just debts. My eighteen hundred dollar bank stock in the First National Bank of Santa Anna, and my two hundred dollar bank stock in the Coleman National Bank of Coleman, Texas, I would hold as an investment. All property or belongings of any kind (not included in the above) I possess at the time of my death, shall be equally divided between my children. I bequeath, will and direct that each of you keep and not dispose of any part of the land I have given you contained in the Wharton county school land, the J. A. H. Cleveland or the Wm. Farris land for a term of twenty-five years after my death. In testimony whereof I have signed my name, H. W. Kingsbery, this the 14th day of July, 1926, at my home, six miles south of Santa Anna, Texas. To my children – If you love me, keep my commandments: First: Be kind, courteous and love your mother.
