The State of Texas

Jan 10, 1848


This indenture made and entered into by and Frederick M. Grimes and his wife, 
Elmira S., to Thos H. Booth  on this 10th day of January  A.D. 1848 
..... the following land  viz
a part of a grant by the Republic of Texas to the heirs of Henry Farley 
deceased as described in Volume (4) fourth No 343 which part is described as 
follows:  viz

Beginning at a stake in the Southerly line of said tract twelve hundred and 
twenty five varas (1225)  Easterly of the Southwest corner of the same.
Thence South 71 deg Easterly by said Southerly line (1937) nineteen hundred and 
thirty seven varas a stake. 

Thence North 19 degrees East
five thousand and ninety nine (5099) to the northerly line of said track 
stake.  Thence north 71 deg west by said northerly line, nineteen hundred  
(1937) varas stake.  Thence  19 deg west Five thousand and ninety nine varas 
(5099) to place of beginning containing one thousand seven hundred and forty 
nine acres more or less. To have and to hold the same together with all the 
privileges appurtenances therein to belonging to him the said Booth, his heirs 
and assigns forever and I do covenant with the said Booth his heirs and assigns 
that I will warrent and forever defend the premises here described against the 
lawful claims or demands of all persons, claims by through or under me.  

In testimony whereof I have hereunto set my hand and seal this tenth day of 
January A.D. 1848.  (Jan 20, 1848(

Before the undersigned, a Notary Public for said State in said county 
personally came F.M. Grimes and Elmira S. Grimes, his wife who acknowledged 
that she signed, sealed and delivered the foregoing deed for the purposes and 
consideration thence set forth.

And she,  Elmira S. Grimes, wife of said F.M. Grimes being of  mind, separate 
and apart from her said husband acknowledged that without fear, threats or 
compulsion on the part of her said husband she executed the same of her own 
free will and account.

In testimony whereof I have hereto set my hand and affixed my seal January 10, 
1848

Additional Comments:
Henry Farley was father of Mary Ann Jane Farley who married Thomas Harper Booth 
around 1833 (probably in Lawrence Co. AL) and Elmira Susan who married F.M. 
Grimes (Washington Co TX).  Henry and wife, Nancy White, and daughter, Elmira 
Susan Farley left for Texas in 1831.

Henry applied for a Texas Land Grant, but died in 1834 before he could receive 
the title.

Daughter, Elmira S. married Frederick M. Grimes.  He was administrator on Henry 
Farley estate and applied for the title to one league and one labor of land 
Henry Farley had been granted.  This application was approved Aug 2, 1828 in 
San Felipe de Austin.

Nancy Ellen White Farley remarried in 1834  to Henry Hudson.  She died in 1838.

This deed is confusing because Thomas Harper Booth whose 3rd wife was named 
Nancy, also had a son, Thomas Harper Booth, Jr. . However, Thomas H. Booth, Jr. 
married Dec 12, 1854 (after this deed of Sept 1854) to Mary Virginia Priddy.

The land was located on the Leon River in what is now Coryell County, Texas.  
These deeds are recorded in Coryell County.

Thomas H. and Mary Booth has these children as proven by deeds in Itawaba 
County and Coryell County pertaining to this inherited Farley Land Grant
