Grimes Coryell County Deed Book D pg 9 The last will and testament of Elmira S. Grimes of Coryell County I, Elmira S. Grimes being sound in body & mind, but being impressed with the certainly of death and wishing to dispose of the property I may die possessed of do ordain and declare my will to be as follows: 1st I give and bequest to my daughter, Mary Ann, now the wife of Daniel Jones, the sum of five dollars to be paid to her in cash by my Executor herein after named immediately after my decease. 2nd. I give and bequeath to my dear husband, Frederick M. Grimes, all my property real personal & mixed of which I amy die possessed whether separate or community property in trust for the following uses: 1st to pay to my said daughter Mary Ann the said sum of five dollars. 2nd to pay all my debts duly established according to law 3rd to divide & pay out to such of my children as may be living or being dead having issue living (except my said daughter, Mary Ann) share & share alike all my property, after paying my debts remaining and after the payment of the said five dollars to my daughter Mary Ann as aforesaid hereby giving & bequeathing to him my said Executor full power over the said property to retain the same till his death or so much thereof as he may see proper to retain. He dividing the remainder as before directed,. Provided nevertheless and it is my will that all my children except my said daughter, Mary Ann, shall each receive an equal part of my said property. 4th. Lastly, I do hereby nominate, constitute and appoint my said husband - Frederick M. Grimes, my Executor of this my last will and testament giving him full power to make & sign such deeds as may be necessary to convey in fee simply real estate and generally to do and perform all things necessary to the winding up of my said estate, without further intervention of the Probate Court than the probating & recording of this my last will & testament, and the taking & returning into the Probate Court & recording an Inventory of my said property by my said executor. In testimony and confirmation whereof I have hereto set my hand & affix my seal using a scroll by way of seal this August 5th, A.D. 1859 Elmira S. Grimes (seal) Witness: R.B. Wells, S.H. Allen G.W. Taylor before me S.H. Allen, Clerk of the County Court in and for the county aforesaid, personally appeared Elmira S. Grimes whose signature, appears to the foregoing will to me well known, who acknowledged that she signed, sealed and delivered the forgoing will of her own free will and accord and having the same explained to her she also stated that she wished not to retract the same or any part thereof and she signed the same without fear or compulsion of her said husband for the purposed & considerations therein.
