GILBERT PLEASANT GILBERT Bond to: NAT. M. STUKES The State of Texas Dewitt Co Know of men by these presents that we JASPER L. GILBERT and PLEASANT GILBERT acknowledge ourselves indebted to NAT M. STUKES in the sum of Three Thousand Dollars for the payment of which well and truly to be made we hereunto bind ourselves our heirs, executors and administrators Given under our hands this the 17th day of June A.D. 1861 The condition of this obligation is such that whereas we have this day in consideration of the sum of thirty five hundred dollars to us in hand paid by said STUKES , sold and conveyed by a deed of Warranty unto said STUKES a certain tract of land in said County out of the BIRD LOCKHART 1/3 league in DeWitt County containing 350 acres fronting the Guadaloupe River and bounded on the West by the R.H. CHISHOLM League and on the east by a tract of land owned by J. W. MEADOR or upon which J. D. ANDERSON now lives, and running back from the river for quantity and whereas BARTLEY GILBERT a minor is the legal owner of our undivided one half of said tract of land and whereas there are certain debts, judgements and liens hanging over said tract of land. Now Be it known that if the undersigned shall procure and obtain from said BARTLEY GILBERT a warranty deed to said land unto the said STUKES upon his arriving at the year of maturity, that is to say on the 30th day of September A. D. 1862 and shall well and truly discharge and pay off all claims, demands or liens upon or against said tract of land then and in that event this obligation shall be null and void, otherwise in full force and effect and further, We for the purposes of making secure the full and perfect payment and compliance on our part with the obligation here assumed, do hereby execute, and deliver this instrument as a lien or mortgage on a stock of cattle running in San Patricio County containing 500 head more or less and branded OZ together with the female increase thereof and as this intended as a lien or Mortgage on said Cattle whenever the obligations herein assumed by us are complied with the same shall cease to exist. Friend and Wm. R. King to me well known and whose names are subscribed to the above and foregoing instrument of writing as witnesses thereto and they being each sworn according to law declare on oath that they saw JASPER L. GILBERT and P.L. GILBERT sign the above Bond and heard them acknowledge the same to be their act and deed, for the purposes & considerations therein setforth and that they and each of them requested them the said W.R.
