GILBERT TITTLE BOND To A. BERRY State of Texas DeWitt County Know all men by these presents that I SARAH E. GILBERT of said State and County am held and firmly bound unto ALFRED BERRY in the penal sum of Five hundred dollars for the payment of which sum will and truly to be made I bind myself my heirs executors & administrators firmly by these presents signed and sealed this 15th day of October A.D. 1846 The condition of the above obligation is such that whereas the above bound S.E. GILBERT hath this day bargained and sold to said BERRY Two certain tracts, pieces or parcels of land lying and being in the County of DeWitt on the Clear Fork of the Sandies One tract containing Six Hundred and Forty acres the other Three Hundred & Twenty at being the same bequeathed to the me ( the Said S.E. GILBERT) by my Father A. LOCKHART as will more fully appear by Reference to the 3a Article of said A. LOCKHART's will for which said land the aforesaid A. BERRY has executed to me his promissory note for One Hundred Dollars bearing equal date with this instrument binds other payments that he the said BERRY has obligated himself to make now if the said SARAH E. GILBERT shall make or cause to be made unto the said ALFRED BERRY a good and sufficient Deed of Conveyance as soon as the field notes can be procured from A SWIFT the former County Surveyor of Gonzales County or a Patent from the General Land Office there the obligation to be null and void otherwise to remain in full force and virtue in law In testimony where of I have hereunto Set my hand & seal the day and date first above written her SARAH E (x) GILBERT (seal) Signed Seal & Acknowledged Wm P. Patterson a subscribing witness to the foregoing Tittle Bond with whom I am well acquainted and after being duly sworn as the law directs deposes and says that he saw SARAH E. GILBERT sign her name to the Seal ( a Scroll) of the above Tittle Bond by making her Mark on the day and date above written in the said Bond and that she acknowledged she done it for the purposes therein contained and requested him and I .C.
