GILBERT The State of Texas County of Colorado This indenture made and entered into this 7th day of November in the year of Our Lord One Thousand Eight Hundred and Fifty Five between John Pinchback of the County of Colorado and State of Texas of the one part and JASPER L. GILBERT of the County of Dewitt and State aforesaid of the other part. Witnesseth that the said John Pinchback for and in consideration of the sum of Two Thousand Dollars to him in hand paid by the said JASPER L. GILBERT the receipt whereof is hereby acknowledged hath bargained, sold and conveyed, and by these presents doth bargain sell and convey unto the said JASPER L. GILBERT his heirs and assigns a certain tract or parcel of land lying situate and being in the County of Dewitt and State of Texas on the west side of the Guadaloupe River, being a third of a league of land granted to John Pinchback Assignee of John Nelson by the Republic of Texas by Patent No. 318 Vol. 3 dated 22d day of December A.D. 1845 bounded as follows: to wit: Beginning at the South East corner of survey No. 18 in Class No.2 granted to RICHARD H. CHISHOLM. Thence due south twenty eight hundred and eighty seven varas to a Black Jack 3 inches in diameter upon which a Post Oak bears S 40 E 5 varas; Thence west 800 varas to a creek runs south in all twenty eight hundred and eighty eight varas to a stake from which a Live Oak bears S 60 W 27 6/10 varas and another bears N 13 East 37 varas. Thence North 2887 varas to a stake on the south boundary line of CHISHOLMS survey from which a Live Oak bears N 59 degrees W 20 varas and a Post Oak bears N 56 degrees E 11 varas; Thence with CHISHOLMS line due East 2888varas to the place of Beginning containing One third of a league of land or 1476 acres be the same more or less. To have and to hold the above described land and bargained premises with all and singular the rights, profits, hereditaments and appurtenances of in and to the said land belonging or in anywise appertaining to the only proper use and behoof of him the said JASPER L. GILBERT, his heirs and assigns and the said John Pinchback doth hereby covenant and agree to and with the said JASPER L. GILBERT that he will for himself, his heirs, executors or Administrators, Warrant and forever defend the tittle of said land and bargained premises unto the said JASPER L. GILBERT his heirs and assigns from himself his heirs, Executors and Administrators and from all and every manner of person or persons whatever caliming or to claim the same or any aprt thereof.
