SMITH The State of Texas County of Dewitt This indenture made and entered into this 15th day of December in the year of our Lord One Thousand Eight Hundred and Fifty five between JASPER L. GILBERT of the County and State a foresaid of the one part and JAMES N=2E SMITH of the County and State a foresaid of the other part Witnessth that the said JASPER L. GILBERT for and in consideration of the sum of Two Hundred Dollars to him in hand paid by the said JAMES N. SMITH the receipt whereof is hereby acknowledged hath bargained sold and conveyed and by these presents do bargain, sell , and convey unto the said JAMES N. SMITH his heirs or assigns a certain tract or parcel of land lying situate and being in the County of Dewitt and State of Texas on the West side of the Gaudaloupe River being a part of the tract of land for 1/3 league granted to JOHN PINCHBACK assignee of JOHN NELSON by Patent No. 318 Vol.3 dated 22 day of December A.D. 1845. The land now conveyed bounded as follows, to wit: Beginning on the N West corner of the original 1/3 league at a stake in the south boundary line of the league of land granted to R. H. CHISHOLM from which a Live Oak bears N 59 degrees W 20 varas and a Post Oak bears N 56 degrees E 11 varas; Thence due east with the south boundary line of R=2EH. CHISHOLM League sixteen hundred and ninety eight (1698) varas to a stake in said CHISHOLMS line which is W. A. BLAIRS corner from which a Post Oak marked as a bearing tree bears due west 4 varas running; Thence due south with said BLAIRS line passing his corner at six hundred varas in all six hundred and sixty five (665) varas to a stake from which a Post Oak marked blaze &chop bears N 45 west six varas another Post Oak bears south 47 degrees East six varas; Thence due west sixteen hundred and ninety eight varas (1698) to a stake in the west boundary line of the original 1/3 league; Thence North with said boundary line six hundred and sixty five varas to the beginning containing by calculation two hundred acres of land be the same more or less- To have and to hold the above described land and premises together with all and singular the righrts, profits, hereditaments and appurtenances to the same belonging or in any wise appertaining to the only use and benefit of him the said JAMES N. SMITH his heirs and assigns forever. And the said JASPER L. GILBERT doth by these presents covenant and agree to and with the said JAMES N. SMITH his heirs or assigns that he will for himself his heirs, executors or Administrators, warrant and forever defend the Tittle of said land and premises unto the said JAMES N. SMITH his heirs and assigns forever against the aTittle Claim or interest of all and every manner of person or persons whomsoever claiming or to claim the same the same or any part thereof. In Testimony whereof the said JASPER L. GILBERT hath hereunto set his hand and seal using a scrawl for a seal the day and date above written. Jasper L. SMITH Clerk of the County Court of said County NICHOLAS LOWRANCE one of the subscribing witnesses to the foregoing deed of conveyance from JASPER L. GILBERT to JAMES N. SMITH bearing date the 15th day of December A.D. 1855 who to me is well known who after being duly sworn as the law directs deposes and says that he is acquainted with JASPER L. GILBERT and that he saw, sign seal and deliver the same and acknowledged it to be his act and deed for the purpose therein set forth and requested him and MATILDA LOWRANCE to witness the same. In testimony whereof I hereunto set my hand and seal of office at office in Clinton this 15th day of December A.D. 1855. James N.
