Ruffin and Loyd Smith, being resident citizens of Ellis County, Texas, and whose statements are worthy of full faith and credit, who, after being by me first duly sworn each on his oath states: That H.J. Ruffin, the grantee in the deed from B.H. Fowler, et al, [Deed Book 179 pg 346 Fowler, B. J. (heirs) to Henry J. Ruffin Nov 23, 1908 in conveyance of 95 4/5 acres of land out of the Simon Warmack survey near the town of Alma, in Ellis County, Texas, was the father of the affiant, C.J. Ruffin; that his wife of the said H.J. Ruffin was Winnie Virginia (W.V.) Ruffin; that they were married only one time and that to each other. Affiants state that the said Winnie Virginia Ruffin is deceased, having died testate on or about October 15, 1915; and that the said H.J. Ruffin is deceased having died intestate on or about July 10, 1916; both having died at Alma, in Ellis County, Texas, at their home same being the property above described; that the wills of each of the above were respectively probated in the County Court of Ellis County Texas with the beneficiary under the will of the said Winnie Virginia Ruffin, deceased, being the surviving husband, H.J. Ruffin; that the beneficiary under the will of said H.J. Ruffin being his deceased wife, Winnie Virginia Ruffin; that the wife, having predeceased her husband, the estate of the said H.J. Ruffin passed by descent and distribution, same being the entire estates of the said Winnie Virginia Ruffin, deceased and H.J. Ruffin, deceased, having passed to the heirs of the said H.J. Ruffin. That the following were the children born of the marriage of the said Winnie Virginia Ruffin and H.J. Ruffin, to wit: 1. Mattie Ruffin, a daughter 2. Elam C. Ruffin, a son; 3. A.T. Ruffin, a son; [Allen Tillman] 4. W.H. Ruffin, a son; [William Harrison] 5. Sallie L. Ruffin, a daughter; 6. George T. Ruffin, a son; 7. Willis C. Ruffin, a son; 8. Rupert A. Ruffin, a son; 9. Claude J. Ruffin, a son; 10. A son, un-named, who died in early infancy That the following were the only surviving heirs of the said H.J. Ruffin at the time of his said decease, and re as follows: 1. Mattie Ruffin who married W.F. Sands, the latter who died on or about May 15, 1916. That the said Mattie Sands is now deceased with heirship fully shown at page 25 in Vol 340, Deed Records of Ellis County Texas. 2. Elam C. Ruffin, who died during the year 1930; who died intestate, with no administration of his estate, there being no necessity therefore; that his wife, Lou Ruffin died several years prior to the death of her said husband; that there was only one child born of their said marriage to wit: Dovie Ruffin, a daughter, who afterwards married A.S. May; the said Dovie May being the only and surviving heirs of the said Elam C. Ruffin deceased. 3. A.T. Ruffin, a son, whose wife if Lillie Ruffin 4. W.H. Ruffin, a son, whose wife was Laura Ruffin; that the said W.H. Ruffin is now deceased, but the one and same party as party grantor in the deed from Mrs. W.F. Sands, et al, to the said Loyd Smith, by deed dated July 15th 1922 of record in Vol 258, page 25 Deed Records of Ellis County Texas. 5. Sallie L. Ruffin who married, George Collard; the latter having died on or about February 27th 1936; that the said Sallie L. Collard is now deceased. [not true she died Feb 16, 1960] 6. George T. Ruffin, whose wife was Lula C. Ruffin; that both are deceased, the said George T. Ruffin died on or about the year 1909 intestate; no administration was had in his estate, there being no necessity therefore. That the follwoing were and now the only surviving heirs of George T. Ruffin deceased: a) James Toliver Ruffin, a son b) G. Clarence Ruffin, a son c) Winnie Ruffin, who married John S. Rowe d) Arthur W. Ruffin, a son e) Alva L. Ruffin, a son 7. Willie C. Ruffin, a son, whose wife is Willie Ruffin 8. Rupert A. Ruffin, a son, whose wife is Minnie Ruffin 9. Claude J. Ruffin, a son, whose wife is Imogene Ruffin. Affiants state that the following are the owners of the tract of land of 55 feet by 125 feet set forth and described by the deed from H.J. Ruffin and wife, W.V. Ruffin to Mrs. Lula C. Ruffin, et al, dated September 17th 1910 of record in vol 187 page 466, Deed Records of Ellis County Texas, together with the original tract of 95 4/5 acres purchased by the said H.J. Ruffin from B.H. Fowler, et al, by deed dated November 23, 1908, of record in Vol 179, page 346, Deed records of Ellis County Texas; save and except certain smaller tracts theretofore conveyed and now of record; such owners with their respective joint interests thereto are as follows: 1. Mrs. Verdie Smith an undivided 1/4 of 7/9th interest 2. Mrs. Maude Carnes an undivided 1/4 of 7/9th interest 3. Mrs. Bessie Griffin an undivided 1/4 of 7/9th interest 4. W.H. Sands an undivided 1/4 of 7/9th interest 5. Mrs. Dovie May, an undivided 1/9 interest 6. C.J. Ruffin, an undivided 1/9 interest Sworn to and subscribed before me, this the 17th day of November, 1943. Before me, the undersigned authority, in and for Ellis County, Texas, on this day personally appeared C.J. Ruffin and Loyd Smith known to me to be the persons whose names are subscribed to the foregoing instrument and acknowledged to me that they executed the same for the purposes and consideration therein expressed.
