Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ***************************************************************** Submitted Feb 10, 1999 by Carla Ratcliff The State of Texas County of Fayette Know all men by these presents that we CHARLES HILLMANN and DORETHEA HILLMANN his wife of said State and County for and in consideration of the Sum of three thousand seven hundred & Eighty dollars to us in hand paid on a title bond for five hundred and twenty acres of land in Colorado County of ___ date with this deeds and his note of hand for five hundred and fifty two dollars by Joseph Holscher of said State and County have granted, bargained, sold released and conveyed, and by these presents do grant, bargain, sell, release and convey all that certain parcel or tract of land containing one hundred and two acres of land about 12 miles East of the Town of La Grange and deeded to CHARLES HILLMANN by N.W. FAISON atty. For WILLIAM HUDSON. Recorded in Book C page 106-107 which tract is part of a League granted to WILLIAM O. BURNAM by the Mexican Government. Also all that certain two tracts or parcels of land containing together Two hundred and ninety four acres of land deeded to CHARLES HILLMANN by FAISON as foresaid and Recorded in Book H page 8 being one hundred and sixty eight acres off Survey No. 10 and one hundred and twenty six acres off Survey No 4 ( excepting)forty acres from said tracts granted to JOHN ELLERBUSH by said HILLMAN. Surveyed Dec 31, 1851 by J. B. ARMSTRONG C.S. F. and five acres granted by HILLMANN to the Lutheran Church surveyed July 25 1859 by said Armstrong. Also all that certain tract or parcel of land of Sixty two acres part of the said BURNHAM League and surveyed for the said CHARLES HILMAN by J. B. ARMSTRONG Dept S F Janz 1, 1852 and is the West half of No. 3 of the division of said League and is described as follows:Beginning at the W of said No 3 a cedar stake, Thence N 44 1/4 E 373 varas a cedar stake. Thence S 47 E 934 varas a stake. Thence S 43 W 373 varas a stake. Thence N 47 W 942 varas to the place of beginning ( Excepting, So much of said 62 acres as was granted to the Catholic Church by said HILMAN, Surveyed for them November 10, 1854 by J. B. ARMSTRONG C.S. F. Containing Twenty Eight acres, and also Eleven acres and 3/4 of an acre deeded by JOHN ELLERBUSH on the 10th day of August 1855) Containing altogether Three Hundred and Eighty One acres and 1/4 of an acre more or less. Together with all and Singular the rights members hereditaments and appurtenances to the Same belonging or in any wise appertaining or incident thereto. To have and to hold all and Singular the premises herein described to him the said JOSPEH HOLSCHER his heirs or assigns forever, and we the said CHARLES HILMAN and wife do for ourselves our heirs and representatives hereby warrant and we will and they shall forever defend the title to said premises and appurtenances unto him the said JOSPEH HOLSCHER his heirs and assigns against all persons legally claiming the same or any part thereof In testimony of all of whichwe have hereunto set Our Hand and Seals , using Scrolls for seals, the Twenty First day of August 1859. She being a party to the instrument of writing hereunto attached bearing date on the 25th day of August A.D. 1859 and having been examined separate and apart from her said husband and said instrument having been by me fully explained to her. She acknowledged the same to be her free act and deed and declared that she had willingly and without fear or compulsion signed, sealed and delivered the same for the consideration and purposes therein stated and that she wished not to retract it also came CHARLES HILLMANN, he being a party of the same and acknowledged that he signed the same for the purposes therein contained
