Division of the Estate of Sarah (Claiborne) Evans
Deed Book V:143
Freestone County, TX

Know all men by these presents, that we E.G. EVANS, as agent and attorney
in fact for Mrs. L.A. EVANS and heirs of J.B. EVANS dec'd and J.H. MCILVEEN
as agent and attorney in fact for heirs of Wm EVANS dec'd and Thomas FERGUSON
as agent and attorney in fact for heirs of Jack EVANS dec'd and Miss E.P.
EVANS for herself alone all of the State and County aforesaid and W.C.D.
MAHONE of Kansas City Mo. All being joint heirs in and to the undivided
lands of Sarah EVANS dec'd situated in said County and State and being
desirous of affecting a mutual and satisfactory division of said land among
ourselves have this day and do by these presents bind ourselves, ourselves
heirs executors and administrators to abide by, ratify, and in all things
confirm the division of said land, as hereinafter specified.

Said land being on the Hugh Henderson, Green L. Stillwell and J.J. Goolsby
original surveys, and being 800 acres and by actual survey made by the
Co. Surveyor of Freestone for the purpose of this division or partition,
divided into Eight Equal parts or shares corresponding with the number
of heir=ships in said Estate of Sarah EVANS decd said land being divided
into blocks or shares and numbered as aforesaid were drawn and allotted
as follows =

J.H. MCILVEEN for heirs of Wm EVANS decd Block No (1) One=100 acres.
E.G. EVANS for Mrs. L.A. EVANS and heirs of J.B. EVANS decd Blocks (2)
(6) & (7) two Six & Seven
W.C.D. MAHONE Block No (5) five
Miss E.P. EVANS Block No (4) four
C.H. STILLWELL for heirs of Elizabeth STILLWELL decd Block No (8) eight
Thomas FERGUSON for heirs of Jack EVANS decd Block No (3) Three

Now therefore we, and each of us do hereby accept and receive the above
and foregoing division, as a final Settlement and division of said land
between us.

And for a more perfect description of our several and individual shares=as
above drawn and allotted reference is hereby made to a plot of said land
hereto attached and made a part hereof. And we do hereby promise contract
and agree with each other that the share or shares drawn and hereby allotted
to us individually shall hereafter constitute our several and individual
interest in said estate as fully to all intents and purposes as though
the same had been done by the District Court in a suit for partition.

And we do hereby bind ourselves, our heirs, executors, and administrators,
to forever warrant and defend unto each other, their heirs or assigns,
the title to the lot or blocks of land hereby drawn, allotted designated,
and set apart to each other, for such is the object, purpose and conclusion
of the instrument.

In testimony whereof witness our hands & seals using scrolls for seals
this Jany 11th A.D. 1884.
