Walters Witness of Pltff’s Rebecca Little 2914 Carrie Ann Walters et al Suit pending in the No. 1206 vs. District Court of Rebecca Little Hunt County Texas Answers and depositions of Carrie A. Walters a resident citizen of Freestone County Texas, to the accompanying interrogatories, propounded to her in the above entitled cause later before A.G. Anderson clerk of the District Court in & for Freestone County Texas in attendance with the accompanying Commission &c. To the first Interrogatory She answers- My name is Carrie Ann Walters, I will be 54 years old The 14th day of Sept next 1876. I reside in Freestone Co. I am a female. I am a party to this suit. I am The wife of H.J. Walters. Auto 2nd Inty We were married on the 8th day of August, 1849 in Cherokee County Texas; we have continued to live together as husband & wife ever since our said marriage. Auto 3rd Inty My father was named Seth Swinford & my mother Sarah Swinford. (mother’s maiden name was Sarah Addenton) They as both dead, my father died in Northern Texas, I think in Lamar Co either in the year 1844 or 1845 – not later than 1845. And my mother died a short time afterwards in Marshall County, State of Mississippi –don’t remember the exact date of her death. Auto 4th Inty There were five other children none of them Living; all died without issues, There are no Others to my certain Knowledge now living, I am the youngest child and after a diligent search of about 30 years I can safely say that there are no other heirs living. Auto 5th Inty I know that my father & mother were husband and wife at my father’s death, that there was never any divorce between them; my mother never married after the death of my father My father was living in Texas at the date of his death- but had no fixed homestead I had during 1839 moved out to Texas, prior to the death of my father They were married prior to the year 1835 and my best recollection is they married between the years 1812 to 1816. Auto 6th Inty My father & mother were married in South Carolina, I was born in Greenville District SC- They moved from SC to North Carolina–thence to Caloway County KY thence to Marshall County State of Mississippi the year of 1837 Col James Bourland, come back to Miss on a visit having previously emigrated to Northern Texas; and my father Seth Swinford accompanied him back to Texas on his return. Auto 7th Inty I was living in Rusk Co. Texas, at my father’s death, I knew he owned lands in Northern Texas, and understood that he owned some personal property at his death. I was first informed of my father’s death by a man by the name of Hiram Jones, who lived in the section of the county where my father died- This was a few weeks after my father’s death, at the same time he informed me that my owned lands & some personal property. About the same time I received a letter from Wm. H. Bourland who lived in the same section of County where my father died & he stated about the same that Hiram Jones had stated in my aid to my fathers death & the property, Hiram Jones also stated to me that Mest. Janus Bourland had or would admins- ister on my father’s Estate & take care of, and look after my land interest thus acquired: Some five years after my fathers death & the reception of this letter, my house was burned up, And all my letters & papers were consumed. Auto 8th Inty There was sent nor was there ever any distributions of the property belonging to father’s estate: I was of the impression that Col. James Bourland had administered on my father’s estate, until about a year ago, where I learned to the contrary by investigation. To the first cross Interogatory She answers- I have no knowledge of my father making any Transfer of any portion of his property during his life there, acquired in the State of Texas. her Carrie A.
