Jordan The State of Texas } April the 1st 1859 Ellis County } Know all men by these presents that I Micijah Bateman of the County of Freestone, for and in consideration of the sum of two hundred and fifty Dollars to me in hand paid this day by Thomas J. Jordan of Ellis County and State aforesaid have bargained sold and conveyed all that tract of land one hundred and seventy six acres secured by the head rite of Green McDonald No 1470 Vol 11 by virtue of Certificate No 1261 a certain tract of land situated lying and being on the waters of Mill Creek in Ellis County Beginning at a stake H. Harrels S. E. Corner from which an Elm bears N 81 E 25 varas auther bears N. 6 ½ W. 29 vrs. Thence S 30 E with A H. Stokes West line One thousand & forty Six vrs to a stake from which an Eam bears S 46 E 17 vrs another S 30 W 19 vrs. Thence S. 60 W to a stake 950 vrs from which an Elam bears N 82 W. 20 Vars, another bears N 82 W 40 vrs . Thence N 30 W. 1046 vrs. to a Stake H. R . Marrols N. E. Corner from which an Elm bears. N 1 . W. 50 vrs a Hackberry bears N 84 W. 48 ½ vrs . Thence N. Co E with said Harrells line 950 in to the place of begining : I M. Bateman do hereby relinquish all my right and claim to the above mentioned land to the said T. J. Oliver, et al. The State of Texas } County of Williamson } Personally appeared before me the undersigned authwitt on this day J. B. J. Oliver known to me he the person whose name is subscribed below to this instrument , and after being duly sworn deposes and says , that the J. M . Oliver to when heirs was granted Surveys No. 26 and 28 in Comal County, Texas, by letters Patent Wm 303 & 343 N. 284 requertively in name of heirs of J. M. Oliver also J. M . Oliver lands in Walde County , our , was the brother of deponent. That in 1835 ar 1836 , the said J. M. Oliver entered in the Mexican War and went from the State of Georgia to Texas, where in March 1836 . he was killed in what is known as the Goliad massacre with Col. Fanning - I only know of the death through our circumstances and public and family history . I know that he entered the army and was with Fanning and war reports him as having been represented him as having been killed as aforesaid. I never saw or heard of him living the seven is ? ? Killed as aforesaid , I never saw or heard of then living thereafter, the said J. M. Oliver left surviving him a father and makes the fathers name was Thomas Oliver his mothers name was Martha Oliver. The said father died intestate in ???? The said mother died about the year 1865 in San Marcos, Hays County Texas. The said father ( ???? Oliver ) left surviving him at this death the following children , to - wit : J. J . Oliver who lived on Haya County and same to his death about the year 1867 . J. R . Oliver who died Co I am informed in ????? County Texas - and the undersigned J. B. J. Oliver of Williamson County where I now reside and and seventy six years of age . Also Catherine Oliver , who was about the year 1845 married to Green McDonald. They had two children born to them about the years 1846 & 1848 . The names of said children were Martha and John who are said to be still living . I do not know if they are or not. My said sister Catharine and her husband are dead , having died about the year 1848 & 1849 . My said father and mother left surviving them us other children . J. B. J. Oliver . Bristow wife of D. B. O. Bristow , and John Bateman of the County of Henderson and State of Thomas , and after being by me duly sworn, deposed and said that their mother is dead having died about the year 1848, intestate that she left surviving out two children to wit: the deponents that their father is also dead having died intestate about the year 1851. That the name of their said mother at the time of his death was Catharine McDonald and that fathers name was freem Mc Donald, That about the year 1855 one Micajah Bateman of Freestone County, Texas, adopted that the said Martha said John and had their six names legally changed to that of Bateman, That their mother was the daughter of James Oliver and Martha Oliver who had four sons and one daughter to wit : J. J. Olive of hay County, Texas, J. R. Oliver of Cherokee County, Texas, and J. B. J. Oliver now of Williamson County and J. W. Oliver, who was only known to us through family history, and as having been killed at the Goliad massacre in 1836 in it was with Mexico. That our said grandfather died intestate, in Rusk County, Texas about the year 1850, and left surviving him the aforesaid four children J. J . J. R. J. B. J. Bristow of the County of Henderson and State aforesaid in consideration of the sum of one hundred and eighty Dollars to us in hand paid by J. F. Guinn? have granted, sold and conveyed, and by these Presents do grant, sell and coming unto the said J. D . Guinn? of the County of Comal and the State of Texas all that certain parcel of land lying and being situated in the County of Oneral and State of Texas , to wit our remaining one half of one eighth of orignial Sunnys No 26 and 88 originally granted to the heirs of J. M. Oliver, deceased in said County of Comal the one eight interest herein mentioned being the interest inherited by the said John Bateman and the said Martha Bristow from their mother who was the daughter of Live Oliver and Martha Oliver and the sixth of said J. M. Oliver deceased , also 2 . 15 . 1 . Oliver J. R . Oliver and J. J. Oliver the said form Bateman and Maria Briston being the duly Million of this matter where inciden name was Catharine Oliver and who died about the year 1848 , the intention being to hereby convey one sixtient of said the orignial swings and to pay the sale of the other one sixteenth heretofore ( on the 4th day of February 1888 conveyed to said Quinn making in all the one eighth interest inherited thereinto our said mation . To have and to hold the above described premises with all and singular the rights and appurtenances thereto in anywise belonging , unto the said J. D . Quinn his heirs and assigns , forever . And we do hereby bind ourselves , our heirs , executors and administrators , to Warrant and forever defend , all and singular the said premises unto the said J. F .
