  of his debt that he owes T. Y. Wells and his representative E. H. 
  Horrel?/Harrel? . ]

    one owed the money to handle money or property during a lawsuit.  ]

county Freestone   }               to any lawful officer
of said county     }               greeting you are hereby
commanded to summon H C Walker to
personally be & appeare [sic] before me or som [sic]
other Justice of the Peace at my office in
Milton on the 1st Saturday in November
next then & there to answer E. H. Horrel [Harrel ?]
Recever [sic]  ___ for the use [?] of T. Y. Wells & c in
a plea [?] of debt per [?] account for the sum
of nine and 98/100 Dolurs [sic] here in paid
not and make due returning  there of according
to law  Given under my hand the 6th
Day of October AD 1853
