Background - In April 12, 1861, the opening salvos of Fort Sumter started the outbreak of fighting that was to become the Civil War. Texas was divided into military brigade districts at the outbreak of the American Civil War for the purpose of organizing state troops for the defense of Texas. The 19th Brigade was composed of men from Navarro, Ellis, Freestone and Limestone counties. This list only shows the Freestone County companies. The militia was organized soon after the outbreak of the Civil War. Below is call to muster: " Headquarters of the 19th Brigade, Texas Militia } Corsicana, Navarro County, July 22, 1861 } General Orders, No. 1 Brigadier General's Instructions to Enrolling Officers In my conformity to my instructions contained in General Orders, No. 3... I am required to appoint Enrolling Officers in the in the several precincts of my Brigade (which is composed of the counties of Navarro, Ellis, Freestone and Limestone counties) whose duty it shall be to call on all citizens within their precients able to bear arms, and not incorporated in companies who have offered their services to the Confederate States, to organize into companies of not less than thirty two, nor more than one hundred, non-commissioned officers and privates. Every able bodied free male inhabitant residing in your precinct, between the ages of 18 and 45 years, and not incorporated in companies who have offered their services to the Confederate States, you will form into companies, and whenever two or more Companies may be formed, they will be distinguished as active Companies and Companies of reserve, whose duties respectively are prescribed in the second section of said General Order, to which I refer you. You are instructed, immediately after said Companies are formed, to hold an election for one Captain, first, second, and third Lieutenant for each Company, which companies shall have the privilege of drilling as Cavalry or Infantry, as they may desire. Immediately after said election is held, you will forward to me a complete muster roll of each of said Companies, the certificatee to the same to be signed by the Captain. A printed form of said muster roll is herewith sent to fill up. HENRY JONES Brigadier General 19th Brigade, Texas Militia. " Besides the men already enlisted, Texas Governor Francis Richard Lubbock called for 14 additional regiments on July 26, 1861. In late 1861, most of militia troops of Freestone County enlisted in the regular army. They joined the “Freestone Freeman” (Company G, 7th Texas Infantry Regiment), the “Freestone County Rangers” (Company B, 12th Texas Cavalry Regiment), “Bradley’s Company” (Company B, 2nd Infantry Battalion, Waul’s Legion), “Mean’s Company” (Company H, 28th Texas Cavalry Regiment), or Company D, 10th Texas Infantry Regiment. On November 29, 1861 General John Bankhead Magruder called for 10,000 more men. In 1862, the remainder would be conscripted. The Confederate Congress passed the first of three conscription laws in April 16, 1862 for all males between ages of 18 and 35, providing for substitution (repealed Dec. 1863) and exemption of ministers, state, city, and county officers and slave owners with 15 or more slaves. On Sept 27, 1862, the age was raised to 45. The Conscription Act of Feb. 1864 called for all men between the ages of 17 and 50. “Regiments” were generally composed of about ten “companies” each of different counties from the same state led by a colonel. A typical “company” was all people from the same county and numbered roughly a hundred privates, eight non-commissioned officers (sergeants and corporals), and four officers (three lieutenants and a captain). Remember over time a few men got promoted to higher ranks due to illnesses or battle field deaths, so a company might have a couple captains over its history. Remember that the 19th brigade was a militia and was temporary regiment done very early before the war really got underway. The purpose of the militia was to defend the county from the Union army should they invade. The militia included many able-bodied men and old men. However, many of the younger militiamen later enlisted in the regular Confederate army when they started recruiting. By late war, the Confederate militia would be called the "cradle and grave" soldiers (all older kids or old gray haired men) when the Union army actually invaded much of the South. Prisoner exchanges were not done during the early stages of the Civil War because the federal government refused to negotiate, since it did not recognize the Confederacy as a nation. Major General John Dix of the North and Major General Daniel Harvey Hill of the South in July 1862 established prisoner exchange rules. Prisoner exchanges stalled for a while after May 1863 when the Confederate Congress adopts a harsh policy to black troops and their officers. Later in the war, the prisoner exchanges where ended when Ulysses S. Grant became overall commander of the Union Army in March 1864. All prisoners in the Eastern theater were to be swapped at Aiken's Landing (now called Varina) on the James River in Virginia (soon changed to City Point, Virginia), and in the West theater at Vicksburg, with the provision that the fortunes of war might render it necessary to change these places and substitute others bearing the same general relation to the contending armies. Note - Roughly only about half of the people from Freestone Co. that enlisted returned from the war. Please note that anything in parenthesis is the author’s speculation. I speculate their name and attempt to cross-reference them to service in a regular military unit that they later join. Abbreviations used are TX. = Texas, Inf. = Infantry, Co. = Company, Reg. = Regiment, Lt. = Lieutenant, Sgt. = Sergeant, and Cpl. = Corporal. -------------------------------------------------------- Source: The book "History of Freestone Co., TX Volume I" pg. 39-45 is a listing similar to the one I show. The book also says, "F Company Muster Rolls The first nine of these companies are designated as units of the Nineteenth brigade, Texas militia, composing the counties of Navarro, Ellis, Freestone and Limestone. Only the Freestone County companies are given. ..." Index cards of the confederate roll summaries show the group enlisted August 1861. Had election of officers on August 10th, 1861. Commissioned on Sept. 16, 1861. Muster rolls begin on August 13, 1861. The original author and my source was Philip Dale Browne, PhD who was a history professor and educator who is now deceased. Dr. P.D. Browne's papers are at Baylor University at the campus in Waco, McLennan County, Texas. The papers still exist and are in the Civil War Collection of Baylor University's Texas Collection.
