Will!

The State of Texas
County of Galveston} I, Frank M. Spencer, of above State and County, do make 
declare and publish this my last will and testament, hereby revoking any
 other heretofore made by me.
1. I desire that all my just debts shall be promptly paid by my executors
2. I have heretofore given my home on North East corner of 11th and Winnie 
streets, Galveston, to my daughters, Carrie May and Flora W. Spencer; hence 
it is no part of my estate nor was it an advancement to my two daughters 
named, but an absolute gift.
3. I desire and it is my will that all sums due or owing me by my children, 
including advances to Bessie for repairing her house, shall be deducted from 
their respective shares of my estate hereinafter willed them, except the 
amounts owing me by my son Walter, which I forgive to him.
4. I bequeath to my daughter, Carrie May, all the furniture, books and other
effects in and pertaining to the homestead, except those in my daughter 
Flora's room which I bequeath to her, Flora.
5. I now owe my son, Davis A. Spencer some money, and if I should owe him 
anything at my death, I direct that it be repaid him with eight per cent per 
annum interest from the due date or dates.
6. I give, devise and bequeath to my children, the residue of my estate of 
every description and wherever situated, in equal portions, share and share 
alike.
7. I desire and it is my will that if Frank Spencer Stubbs wishes to attend 
the University of Texas the expenses thereof shall be paid by my estate, not
to exceed one hundred and seventy dollars ($170.00) per annum.
8. I constitute and appoint my son Maury M. Spencer and my daughter Carrie 
May Spencer the joint executors of this my last will and my estate with full 
power to sell, convey and dispose of the same, or parts thereof, and it is 
my wish that they act together, if both are living, if not the survivor of 
them shall have the same powers and perform the same duties as both had. I 
will that no bond or other security be required of them, or either of them, 
and that no action of the County or other Court be had in the settlement of 
my estate, except to probate my will and file an inventory, appraisement and 
list of claims of my estate.
In witness of all which I hereto subscribe my name at Galveston, Texas, this 
25th day of May, A.D. 1905.

undersigned witnesses each of whom is above the age of fourteen years, and 
who, at the request and in the presence of the testator and in the presence 
of each other, sign the same as witnesses thereto.

Proof of Will.
The State of Texas  }				Estate of
County of Galveston}			Frank M. Spencer	Deceased

Proof of Last Will and Testament of Frank M. Spencer, Deceased. This day 
personally appeared in open court J. C. Geudler who, being duly sworn as a 
witness in the above entitled matter, and examined on behalf of the applicant 
to prove said Will, say; I was well acquainted with Frank M. Spencer, 
deceased, during his lifetime; I knew the above descendent for about 20 
years before his death; the signatures of the said deceased to the 
instrument now shown to me, and offered for probate as his last Will and 
Testament, filed in this court on the 2nd day of August A.D. 1907, and 
bearing date on the 25th day of May A.D. 1905, was made by the deceased on 
said last name date at Galveston in the presence of myself, J. C. Geugler, 
James B. Stubbs, J. F. Simmons and Felix T. Simmons, the other subscribing 
witnesses; all of said witnesses being over the age of 14 years.  At the 
time of the making of said Will, the testator was of sound and disposing 
mind and memory, and he declared said Will so made by him to be his last 
Will and Testament, and thereupon signed my name as a witness, together 
with James B. Stubbs, J. F. Simmons and Felix T. Simmons at the request of 
the said testator, in his presence and in the presence of each other.  The 
said deceased at the time of the execution of said instrument was over 70 
years of age; the said Frank Spencer departed this life on the 14th day of 
July A.D. 1907, about 2 years, one month and 20 days after making said Will 
in the county of Galveston, in the state of Texas, where and at which time 
his residence principal estate was situated and without having revoked said 
Will so far as known to affiant.		J. C. Geugler
