Page 71 Letter # 71 Dec. 21st 1848 Jesse Your letter of the 4th Octr was recd therewith and is now before me. I recd one from Nancy at the same time-I was looking at the wrong letter your last was written the 21st Sep &recd 10th Octr. Nancy says they are looking for me this winter and if I go there she will come home with me. I now see that I cannot visit Texas this season it would be gratifying to my feelings could I do so but things which I cannot control has put this matter out of all doubt. Finding my calculations baffled and entirely upset in this intended visit I think it would be best for me to say don't look for me anymore and if I ever find leisure and expense money disposi -tion will not be wanting then I may visit that country. As this winter will be one of leisure with you I propose to meet you in New Orleans at such time and place as you may appoint by letting me know when and where I may find you, if you can come make your appointment and unless disabled before then I will not fail to meet you and carry with me the money I owe you If you cannot meet me in N.C. I hope you may have the chance of sending by some safe hand for your money=about the first of March would suit me to meet you or to pay over what is due you. Was I to tell you that I have just paid $437.50 for my old friend Frisbie. I presume you would think it was high time you had your money out of my hands. This indeed is a fact that I have paid this sum for his estate by a trick in law which his widow and son as admrs availed themselves of for present relief. If the estate should be solvent I will work them both by & by. Page 2 As you will want to know what trick has caused me to pay this I will explain it. I was Frisbies security in bank on a note upon which he was sued and judgment before this death and the execution pressing him for the purpose of delay he took up the case upon a writ of error to the Supreme Court Atcherson Security on the error bond before judgment was confirmed by the S. Court Frisbie died and judgment was taken against him without notice to representatives this of course was illegal against Frisbies estate but legal against me and it changes the execution was against Frisbie & securities and we were compelled to pay $437.50 each it forced to draw against my cotton crop for $385. This is the way my crop went last year ??? not one dollar has he refunded nor has he wrote to me ??? the subject. These two friends are all that I have had to pay ??? many years & there is but one more for which I am liable ??? soon be settled. When you get your money I shall be free ??? if my own liability for others and will probably remain so. I made a large crop of corn and uncommon crop of cotton for the quality of land I have about ??? bales to pick out have packed ?? and have some to gin. My bales will average 525 pounds. John ? has bought and moved to the Toulmin place 14th inst he sold his place in Mis. For the same he gave for this I can spare him corn enough for his use till he can raise corn. James Worsham is now building & will soon move to the Book Smith old place. A number of wealthy planters from Sumter, Green and Marengo County have lately come into Old Washington & commenced the turpentine business. They are originally from N.C. and know what they are about. Page 3 I received some time since a letter from R.H. Grimes he spoke of coming to Ala. This winter unless I went to Texas. If Henry should come I shall be much gratified to see him perhaps it may convenient for you to come with him if not all the way at least to N. Orleans. I have just got a letter from Thos. Grimes he is living in this state in Coffee County. Isaac is there also Jacks widow and her children married & single there is a goodly number of them. Stephen is in Dale and Bryan in Marengo. Lewis in Georgia & Wm. Widow there with him. I presume they are all poor and Tom is in rather a bad thin(?) Myself and family are all well and have been from the beginning of the year. There has been but little sickness in this neighborhood. I have company which hurrys me & I believe I have write all I had to write.
