Dunkin -vs- H.S. Dunkin April 4th 1901 On this day this cause being called came the plaintiff by attorneys and announced ready for trial. And it appearing to the court that the residence of the defendant H.S. Dunkin is unknown, and that the said defendant has been duly sited by publication in a news paper published in Hunt County Texas to appear and answer in this behalf, and that such service and citation was perfect to this term of the Court, and B.F. Vaughan, Esq. an attorney of this Court having been appointed by the Court to represent the defendant, came also and announced ready for trial, and the parties waive a jury and submit the matters in controversy as well of fact as of law to the Court. And the Court having heard the pleadings of the parties, evidence adduced, argument of counsel, and considering the law, finds for plaintiff. It is therefore considered, adjudged and decreed by the Court that the bonds of matrimony existing between Mollie T. Dunkin, plaintiff, and H.S. Dunkin, the defendant, be and the same are hereby dissolved. It is further ordered, adjudged and decreed by the Court that the custody and education of Rossie Dunkin, age 8 years, Mitchiner Dunkin, age 6 years, and Annie Dunkin, age 4 years, children and issue of the marriage of the plaintiff and defendant, be and the same is hereby awarded to plaintiff, Mollie T. Dunkin. And it further appearing to the court from the pleadings and the evidence that the following described lot as parcel of land belongs to plaintiff and defendant, and is community property, to wit: In City of Greenville, Hunt County Texas, and part of lot 4 in Block 4 of Jenkin’s property as shown by plot recorded in Probate Minutes C page 364, Hunt County Texas. Beginning on East side of Stonewall Street at a point where the same Continuing: Hunt County, Texas, Court Minutes, Volume M, page 601: crossed the S.B. line of lot 5. Thence South 114 13/100 feet to S.B. line of lot 4. Thence East about 75 feet to W.B. line of L.M. Brizendine survey. Thence North with same 114 13/100 feet. Thence West about 75 feet to beginning. And it further appearing that the custody and education of the children of said marriage is herein awarded to plaintiff, it is therefore further ordered, adjudged and decreed by the Court that all right title and interest of the defendant H.S. Dunkin, in and to the above described property, be and the same is hereby divested out of said defendant and is hereby vested in said plaintiff. And it is further ordered adjudged and decreed by by (sic) the Court that the right of the sole use and enjoyment of said property and the right to collect, receive use and enjoy the rents income, revenues and profits of the same is hereby adjudged to said plaintiff, Mollie T. Dunkin, and that the plaintiff recover of defendant all costs in this behalf incurred for which she may have execution.
