J. Herring, do hereby make application to the Commissioner of Pensions for a pension, to be granted me under the Act passed by the Thirty-third Legislature of the State of Texas, and approved April 7, A. D. 1913, on the following grounds: I am the widow of S. A. Herring, deceased, who departed this life on the 21 day of June, A. D. 1911, in the county of Johnson, in the State of Texas. I have not remarried since the death of my said husband, and I do solemnly swear that I was never divorced from my said husband, and that I never voluntarily abandoned him during his life, but remained his true, faithful and lawful wife up to the date of his death. I was married to him on the 29 day of October, A. D. 1874, in the county of Cullman, in the State of Ala. My husband, the said S. A. Herring, enlisted and served in the military service of the Confederate States during the war between the States of the United States, and that he did not desert the Confederate Service. I have been a resident of the State of Texas since prior to January 1, A. D. 1900, and have been continuously since a citizen of the State of Texas. I do further state that I do not receive from any source whatever money or other means of support amounting in value to the sum of $300.00 per annum, nor do I own in my own right, nor does anyone hold in trust for my benefit or use, estate or property, either real, personal or mixed, either in fee or for life, of the value of one thousand dollars, exclusive of the home of the value of not over $1,000.00; nor do I receive any aid or pension from any other State, or from the United States, or from any other source, and I do further state that the answers given to the following questions are true: 1. Herring, applicant for pension and that they personally know that the said Mrs. M. J. Herring has been a bona fide resident of the State of Texas since prior to January 1st, A. Hewlett known to me to be a creditable person who after being by me first duly sworn on his oath deposes and says that he is a resident citizen of Lowndes County an State of Mississippi and that he is ___ years old, and that he is well acquainted with S. A. Herring who enlisted in the Confederate Army in the State of Alabama in 1862 in Company "H" 12th Alabama infantry, Regiment Rode's Brigade, D. H. Hills Division, Army of Virginia, Gen. R. E. Lee commanding, and discharged in 1865. No honor or more faithful solder, than S. A. Herring your husband belonged to the Confederate Service. I was his Captain and know where of I speak. We was not only comrads in war but playmates in Boyhood. I not only loved him as a soldier and citizen but loved him as a brother. No survivors of the War was more worthy of a pension than S. A. Herring, and of course his widow is intitled to like consideration as in such cases as provided by law. I was also acquainted with Mrs. M. J. Herring, widow, for we all lived in and near Cullman County, Alabama, and the said S. A. Herring as herein before stated and that he never at any time deserted from his poste nor the Army of the Confederate States. (signed) A. E. Hewlett Capt. Co. H, 12th Ala Reg. Senter who is personally known to me to be creditable citizen who after being by me duly sworn on oath states that he personally knows that Mrs. M. J. Herring, applicant for a pension as the widow of S. A. Herring deceased, is in truth and in fact the widow of S. A. Herring deceased and he personally knows that she has never remarried since the death of her husband for whose services she claims a pension and that he is not interested in this claim. And that he further states on his oath that he has known the said Herring family in Texas for near these 18 years in Ellis and Johnson Counties and that they was bona fide resident citizens of said State all these years and that they resided in said counties 1st in Ellis and then in Johnson as bona fide citizens prior to 1st day of January 1900 and long before said date and all these facts herein stated are within my personal knowledge an that I am not interested in this claim and I personally know Mrs. M. Herring, known to me to be a trustworthy citizen of said county and is intitled to credit. Who after being by me first duly sworn as the law directs, who on his oath deposes and says that he was borned in the State of Alabama 72 years ago, and that he is a brother of S. A. Herring, who departed this life in Johnson County, Texas, so he is informed, and believes on or about the 21st day of June 1911. And I am also acquainted with his widow M. J. Herring, and know that they was married on or about October 29th 1874 in the county of Cullman and State of Alabama and I know that my brother S. A. Herring enlisted in the Confederate Army about 1862, served until the close of the war of the rebelion and that he moved to the State of Texas about thirty (30) years ago or more and he and his wife, M. J. Herring, lived together from the date of their marriage until his death in June 1911, and raised a large family of children and to the best of my recolection he enlisted in Company "H", 12th Infantry Alabama regiment and served as a soldier in the army of Virginia until the end of the war, and that he never deserted the army to my knowledge and if he had, I am sure I would have heard of it and that I have lived in the County of Falls for the last 42 years and the State of Texas for the last 42 years past. And they further say on this oath that they was well acquainted with the said S. A. Herring in his lifetime for more than eighteen years before the said S. A. Herring (died) and they personally know that the said S. A. Herring and his wife have been bona fide residents of the State of Texas since prior to January 1st 1900 and long before said 1900 and that the said S. A. Smith, do hereby certify that I am the person to whom is entrusted the paying of the accounts and indebtedness of the late Mrs. Martha J. Herring, who was a pensioner of the State of Texas, and whose file number is 28706 and whose original county was Johnson. The said pensioner Mrs. Martha J. Herring, died on the 11th day of July 1939, in the town of Dallas, County of Dallas, Texas. The pensioner died in the home of Mrs. R. L. Reavis who was related to the pensioner as daughter. That the warrant, which application is hereby made for, shall be applied to paying all or part of the funeral expenses incurred by the said pensioner. Part I further certify that the warrant for the current month has not been cashed by the pensioner, to the best of my knowledge and belief. That said body was prepared for burial by me on the 11th day of July 1939, and that I am of the opinion that warrant herein applied for should be issued to the said Joe H. Roland Brown M.D., do certify that I am a practicing physician, and that I attended Mrs. Martha J. Herring in his last illness, and am of the opinion that his ailments were senility and pyclitis.
