Ballard widow's Pension Application Republic of Texas Military Service. STATE OF TEXAS IN COUNTY COURT - NOVEMBER TERM 1878 COUNTY OF KAUFMAN.. In the Honorable county court of said county: Your petitioner Nancy Ballard, a resident of Kaufman County and state of Texas respectfully represents that she was the legal and lawful wife of Barkley M. Ballard, deceased and who departed this life at his residence in Kaufman County, Texas on the 23rd day of September A.D. 1878 - that said Barkley M. Ballard was a surviving soldier of revolution of Texas and served in the war between Texas and Mexico and in the Republic of Texas between the commen cement of the revolution at Gonzales in the year 1835 and the first of January 1837, and received a pension from the State of Texas under the former pension acts and of said State and was drawing a pension from the state of Texas at the time of his death under the pension laws of said state, paper approved July 28 A.D. 1876 as may be seen by reference to the records of the Comptrollers Office. That petitioner is poor and in indignant circumstances and is over sixty (60) years of age that she has no one upon whom she can depend for support. That she still is unmarried and the surviving widow of deceased. That she has no separate property and deceased left not sufficient funds for her support, except the property exempt by law. Teague, Judge of the County Court of the said county of Kaufman do herebycertify that the above and foregoing is a correct copy of the original application for pension as filed by Nancy M. Ballard on the 14th day of October A.D. 1878 that said Nancy M. Ballard resided in the county of Kaufman and that she appeared and made proof to the satisfaction of the court that the matters and things alleged in Said application are true and that the said applicant is entitled to drawa pension from the state of Texas under the Act of the Legislature of said state for said purposes July 28 A.D. 1876. Teague, County Judge presiding NANCY BALLARD VS THE STATE OF TEXAS 1..W..6..D...November 23, 1878 Now of this day came on to be heard the application of Mrs. Nancy Ballard for a certificate of this court as to her right to an annual pension under act of the legislature of Texas entitled "An Act to provide annual pensions for the surviving soldiers of the Texas Revolution and the surviving signers of the Declaration of Texas Independence and the surviving widows of such soldiers and signers" approved July 18, 1876 that said Nancy Ballard appeared in person and by counsel, James S. Woods, County Attorney appearing in behalf of the state of Texas. It appearing to the court from the proof adduced that the said Nancy Ballard is the surviving widow of Barkley M. Ballard late of Kaufman county, Texas that said Barkley M. Ballard was a volunteer in the War between Texas and Mexico in the army of the Republic of Texas between commencement of the Revolution at Gonzales in 1835 and the first day of January 1837 and that the said Nancy Ballard is in indignant circumstances. It further appearing to the court that the application of said Nancy Ballard affidavit and the affidavits From other creditable persons an contains a full statement of the facts which entitles her to receive said pension and that notice of the filing of said application has been given as required by law. It further appears to the court that said Nancy Ballard is a resident of Kaufman County Texas and that said Barkley M.Ballard has departed this life and thatsince his death the said Nancy Ballard remains and has always been unmarried. It is therefore ordered, adjudged and decreed by the court that the applicants prayers be granted.
