Lee Estate, Lamar Co., TX PROBATE – VENDOR LIEN; PROBATE COURT-1869 TERM; STATE OF TEXAS, LAMAR COUNTY; To the Honorable G.W. DeWitt, Judge of The County Court, Lamar County, Texas, Sitting for Probate and other like purposes. The Petition of E.L. Dohoney, V.W. Hale and William Booth all resident citizens of Lamar County, Texas, would respectfully represent that they are the Owners and holders of a probated claim for $1,772.10, principal and interest which amount is liquidated by the certain promissory Note of Peter A. Lee., now dec'd and dated June 8th 1863 to C.H. Roach for $1074.00 with ten percent interest from date and due one day after date which note was executed in Consideration for the following described real estate situated within the Corporate limits of the City of Paris, being the Homestead of the Family of Said deceased, and upon which they now reside and being the same conveyed to Said Peter A. Lee by Benjamin F. Forney and his wife Catherine, which Deed is recorded in the Office of the Clerk of the County Court of Lamar County Texas in Record Book "R" page 198, in which Deed the vendors lien is and was retained to secure the payment of the above described note. Said land is bounded as follows (to Wit), Beginning at a Stake, the NW corner of W. W. Jones Tract now owned by William Booth-Thence East 138 ¼ vars a Stake in the NE of Said Booth's tract-Thence N 240 vars a Stake near the Pine Bluff road, where a red oak (?mk (*degree-sign?)-RS 22 (*degree-sign?) W 4 vars- Thence W 138 ¼ vars a Stake whereas a hickory (mk-*degree sign)X vars, S 25 (*degree sign)- Thence S 240 vars to the place of Beginning containing 5 7/8 acres and being part of the HR of the Said Davis. Petitioners would further state that since the execution and delivery of said note to said Roach, they have purchased the same and paid therefore a valuable consideration, and are now the legal and equitable owners, holders thereof and which will be exhibited on the hearing hereof- They further state that Henry H. Dohoney was by your Honors Court, at it's December Term 1869, appointed Administrator of the Estate of Said Peter A. Lee, dec'd and has given bond and taken the oath required by law. Wherefore Petitioners prays your Honor to make and order enforcing the vendor lien against said land requiring said administrator to sell the same to the highest bidder for cash in hand, at the Court House door as the law requires and apply the proceeds of said sale, or a Sufficiency thereof to the payment of Said claim and for all proper relief, general and special.
