Miller, 8 " June 1852 The last will and Testament of Richard G. Miller. I, Richard G. Miller of Lamar County and State of Texas, knowing the uncertainty of life and now of sound mind, make this my last will and testament. I resign my soul to its creator, in humble hope of its future happiness, Faithfully relying in the dispersal of a being infinitely good. 1st I give to my beloved wife Rebeckah Miller, three hundred seventy four and one half acres of land including my residence, the same being the one half of my lands unsold, given her the power to have her portion surveyed to suit herself, and her Death to belong to my youngest son Henry Porter Miller. All the slave property we now own was given to my wife by her parents. I give the same to her to dispose of as she may think proper. I give to my wife all my personal property. my executors are to pay all my debts. I also give my wife the last years crop. I give my son Richard F.M. Miller the balance of my home tract of land, three hundred seventy four & one half in the timber, as my executors may direct. If either of my sons R.F. M. Miller or H.P. Miller die without children then one portion of the land to go to my wife and the other to my daughter Laura Epps Miller. If both my sons died without children then one portion of the land to go to my wife and the other to my daughter L.E. Miller, and I Richard G. Miller do hereby make and appoint my beloved wife Rebekah Miller and my son Hezekiah Miller my executrix and executor of this my will and that no other action shall be had in the County Court in Relation to the settlement of my estate than the probate & Registration of this will. In testimony whereof I have set my hand and seal this 14th of February 1852 R.G. Miller witness William Fuller D.A. Skidmore A codicil of the above will. By this codicil I wish to explain why some of my children receive nothing in this will. The children of my first wife Received from me all the property given to their Mother by her parents Consisting of slaves and personal. The slaves we now own was given to my present wife Rebeckah by her father and of her property I have sold a Negro woman for eight hundred dollars and a tract of land for nine hundred dollars making in all seventeen hundred Dollars the lands and personal property I leave to my wife and her children is the compensation I make for the seventeen hundred dollars that justly was theirs. My greatest wish is to do right to my children as they are all near and dear to me, and I hope that this explanation and disposition I have make will be appreciated my all. Skidmore citizens of the state and County aforesaid and as subscribing witnesses to the last will and testament of Richard G. Miller deceased, do solemnly swear that we saw the said Richard G.
