The petition of Daniel Moore a citizen of said county and state to Your Honor that S. E. Goodrich late of said County departed this life intestate having a considerable estate real and personal in said county and some minor children. Petitioner further states that said estate is without administration and that the said minors are the grand- children of petitioner, petitioner further states that the interest of all parties concerned in said estate will be advanced by administrations of the same. The ______ considered petitioner prays that due and legal notice be given and at the next term of the Honorable County Court of said County pertaining to Estates Letters of Administration on said estate be granted to petitioner upon such terms as shall be legal and proper. Goodrich dec=92d Filed Sept 29th 1866 Davis or Wright proxies Atty. for Plantiff State of Texas, Lamar County} District Court To the Honorable S. H. Mabane Judge of the 8th Judicial District residing within & for the County and State aforesaid. The plaintiff James H. Owsley a resident of the County of Lamar and State of Texas respectfully represents to your Honor that Daniel Moore also a resident of the County and State aforesaid on the 30th day of March AD 1863 qualified and entered into a bond of twelve thousand dollars in the Probate Court of said County of Lamar as the administrator of Sterling E. Goodrich deceased late of the County and State aforesaid with I. W. Wells and William H. Tinnin as his securities which said bond on the day and date aforesaid was duly approved by the Chief Justice of Lamar County and Letters of Administration were duly issued to the said Daniel Moore, who entered fully in the duties of this office as administrator of said estate and on the 30th day of March AD 1863 filed with said court his inventory and appraisement bill of the real and personal property estimated in the sum of six thousand dollars which was subject to administration in the hands of said administrator. Petitioner further alleges that the said administrator having taken upon himself the oath of office required by law, never did in the exercise of his official functions to sell off the personal property and most of the real estate of the said Sterling E. Goodrich dec=92d and applied the money thus realized to the payment of claims in full which had no precedent under the law - excluding claims accepted by himself and approved by the Court of a higher classification from payment. Petitioner further charges that it fully appears from said inventory of said administrator that the said Goodrich at the time of his death had a large amount of money due him on good notes and accounts which the said administrator has failed to collect or to take any legal or other action for the collection of the same but has continued in a reckless course of administration - collecting nothing and paying out unapproved claims as aforesaid until the 2nd day of October AD 1865 when the petitioner filed in the County Court of Lamar County, this Petition setting forth in substance that he held an accepted and approved claim against the estate of the said Sterling E. Goodrich deceased for the sum of six hundred and seventy nine & twenty one hundredths dollars credited by thirty two dollars which was then due & [not] paid to him and that said administrator by his annual exhibit filed May 20th AD 1864 and his reports of property belonging to said estate & ___ that he then had on hand funds & property of said estate amply sufficient to pay all indebtedness thereof. And petitioner further charges that said estate at the time aforesaid was entirely solvent and has been & still solvent. Petitioner further sets forth & charges that said administrator by his answer to Petition of this petitioner and accompanying exhibit filed amongst the papers of said estate Dec 1st AD 1865 admits the claim of this petitioner as part of the indebtedness of said estate - together with other claims amounting in the aggregate to the sum of fourteen hundred and thirty five & 24/100th dollars and that from the sale of lands and other sources he had received as trustee for said estate the sum of twenty two hundred and forty nine & 72/100th dollars & paid out the sum of twenty four hundred & eighty five & 87/100th dollars in Confederate States money which petitioner alleges was fraudulent against himself and all the other creditors of the late Sterling E Goodrich dec=92d. Petitioner further charges that said administrator had paid out in specie as per reports filed various claims, therein enumerated the sum of nine hundred and ninety four & 94/100th dollars in full on claims not preferred under the law without declaring any prorated distribution amongst creditors. Petitioner charges that the [actions] of said administrator from the time he entered upon the duties of his office unto the present time have exhibited a reckless disposition to squander said estate & to appropriate the sums to his own use regardless of the rights of creditors or the confidence reposed in him by the deceased. Petitioner further charges that the report of said administrator admits that the said Sterling E Goodrich at the time of his death on the day of AD 1863 left no wife and two minor children by the names of Mary E. & Nancy S. F. as his only heirs at law for whom the Homestead was claimed. And it appearing to the satisfaction of the Court that there was no homestead belonging to the said estate it was ordered & decreed by the Probate Court of Lamar County that the sum of two thousand dollars be set aside for the benefit of said minors in lieu of the homestead being the value thereof fixed by the statutes for homesteads in towns and cities and also that the blacksmith tools belonging to said deceased and also the household and kitchen furniture not excluding two hundred dollars in value being exempt from forced sale for the debts of said estate. It is therefore ordered that the same be set aside for the benefit of said minors and the sum of fifty dollars in lieu of said articles of husbandry and the sum of fifty dollars the value of one horse or of pair of oxen in lieu of the specified articles above named there not being any of said articles on hand belonging to said estate. And it is further ordered and provided that the said minors or those acting as next friend or guardian in their behalf shall not take other property at its appraised value in lieu of the above amounts. That the administrator proceed to sell for cash any portion of said estate to raise the amount above stated. Petitioner further shows that the said administrator (Daniel Moore) proceeding in his reckless course of administration on the 6th day of Feb. 1866 sold Lots 3 & 4 / Block 17 in the City of Paris and I. W. Wells as guardian of the minors of the deceased bid off said lots for the benefit of said minors at __ And also on the same day the tract of land purchased by deed from E. H. Bernard was bid off by the said I. W. Wells guardian as aforesaid for the benefit of said minors for the sum of $200.00. And also on the same day the tract of land purchased by deed from D. W. Mosely was bid off by the said Wells as aforesaid for the sum of $210.00 for the benefit of the said minors. Making in the aggregate the sum of $1010.00. Petitioner further charges of sets forth that on the day and time of said sale he was present by his authorized agent (Tho. B Davis) who bid the sum of $1500.00 for the first lot of land sold. One thousand for the second and five hundred for the third lot. Making in the aggregate the sum of three thousand dollars which was bid by this petitioner as condition of the estate of the said S. E. Goodrich dec=92d but that the said administrator being present at the time forbid the auctioneer from crying any bid made by the agent of this petitioner which said bids of his were not cried and the [land] of said deceased sold for about $2000.00 less than its real value. Thereby from this and other acts of said administrator unauthorized by law making an insolvent estate out of one which was then and has been solvent. Petitioner further charges that said administrator took the receipt of said guardian for the sum of 1010 dollars and executed deeds to him as guardian of the minor heirs of the said S. E. Goodrich deceased which said report and action was approved by the Court. Petitioner charges that the whole conduct of said administrator & the actions of the Court aforesaid set forth and ___ was illegal and unjust to himself and other creditors from beginning to end and asks that he be permitted to file a transcript and for a Writ of Evidence that the whole of the acts & doings in regard to said estate may be revised and corrected. Owsley who testified under oath that the facts set forth in the above & foregoing petition are true and correct this September the 24th AD 1866. J. W. Mabny, Judge 8th Judicial District 6) State of Texas, Lamar County. In the District Court of Lamar County, Texas Nov Term, AD 1874 To the Honorable John E. Easton, Judge of the Eighth Judicial District of Texas, sitting on matters of Probate. The petition inparte (?) of Nancy S. F. Brandon (alias Goodrich) joined by her husband, Thomas J. Brandon who reside in Johnson County, Texas and Mary E. Goodrich who is a minor and represented by her guardian, J. J. Hamilton both of whom reside in Lamar County, Texas would respectfully represent and show unto your Honor that the said Nancy S. F. Brandon (alias Goodrich) and Mary E. Goodrich are the heirs and only heirs of S. E. Goodrich deceased, and that the said S. E. Goodrich died seized and possessed of the following real property which still belongs to said estate * and is now the joint property of your petitioners, to wit: Lots no. 3 and 4 in Block no. 7 as designated on the plat of the City of Paris, Beginning at the South East corner of said Block 7 thence North 216 feet a stake - Thence West 108 feet a stake - Thence South 216 feet a stake - Thence East 108 feet a stake to the place of beginning. Also another tract situated one half mile N. E. from the public square in the City of Paris in said County and State - Beginning at a stake Jerkin=92s S. W. corner - Thence East with Jerkin line 16 poles a stake - Thence South 40 poles a stake near a red oak marked X & 3 chaps - Thence West 16 poles a stake - Thence South 40 poles to the place of beginning containing 4 acres more or less. Petitioners state that as heirs of the said S. E. Goodrich deceased they are entitled to equal portions of said estate, Wherefore they pray for the appointment of a surveyor and commissioners to partition said above described real estate according to value between your petitioners and for all proper relief both general and special.
